<br />RESOLUTION 96-972 <br /> <br />"A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, ESTABLISIDNG NEW RATE PER EQUIVALENT <br />RESIDENTIAL UNIT FOR THE CITY OF CASSELBERRY STORMWATER AND <br />LAKE MANAGEMENT UTILITY; PROVIDING FOR CONFLICTS, <br />SEVERABILITY AND EFFECTIVE DATE." <br /> <br />Whereas, the City of Casselberry bas adopted Ordinance 759 providing for the establishment of a <br />Stormwater and Lake Management Utility, which provides for the establishment of Stormwater utility rates by <br />resolution; and <br /> <br />Whereas, the City Commission of the City of Casselberry bas studied and analyzed the rates for <br />Stormwater Utility Services that are necessary to meet projected revenue requirements; and <br /> <br />Whereas, the existing rates for Stormwater Utility Services were projected to produce the revenue <br />deficiencies as projected; and <br /> <br />Whereas, it became apparent the Stormwater Utility revenue does not meet our internal budget <br />projections; and <br /> <br />Whereas, the City Commission finds that it is necessary to amend the Stormwater Utility fee rate stated <br />in Resolution 93-755. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. A unit charge rate of$2.901E.R.U. is hereby set as the Stormwater and Lake Management <br />Utility rate to be enacted as of January I, 1997. <br /> <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions <br />of this Resolution are hereby repealed. <br /> <br />SECTION III Severability. If any Section or portion of a Section of this Resolution proves to b~ <br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of <br />any other Section or part of this Resolution. <br /> <br />SECTION IV. Effective Date.
