<br />ORDINANCE NO. 07-1214 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />SUBMITTING TO THE ELECTORS OF CASSELBERRY PROPOSED <br />AMENDMENTS TO THE CHARTER OF THE CITY OF CASSELBERRY <br />AT A SPECIAL ELECTION TO BE HELD JANUARY 29, 2008; <br />PROVIDING FOR REVISIONS TO ARTICLE V, SECTION 26 (CITY <br />MANAGER), ARTICLE VI, SECTIONS 27 AND 30(APPOINTED <br />OFFICIALS), ARTICLE XI, SECTION 62 (MISCELLANEOUS <br />PROVISIONS); ARTICLE VIII, SECTION 38 (ELECTIONS); <br />PROVIDING BALLOT TITLES, SUMMARIES AND TEXT FOR THE <br />PROPOSED AMENDMENTS; PROVIDING FOR THE CALL OF A <br />REFERENDUM ELECTION; PROVIDING FOR DIRECTION TO THE <br />CITY CLERK; PROVIDING FOR ADJUSTMENT OF INCUMBENTS' <br />TERMS; PROVIDING FOR CONFLICTS, SEVERABILITY; PROVIDING <br />FOR EFFECTIVE DATE FOR APPROVED AMENDMENTS; <br />PROVIDING CODIFICATION AND EFFECTIVE DATE FOR THE <br />ORDINANCE. <br /> <br />WHEREAS, on October 9, 2006, the City Commission unanimously approved <br />Resolution 06-1 723-A supporting the Commission - City Manager form oflocal government in <br />the City of Casselberry; and <br /> <br />WHEREAS, the City Commission recognizes certain weaknesses in the present Charter <br />regarding principles of the most effective functioning of the City Manager operating under <br />Commission - City Manager form of local government, specifically the full authority to appoint, <br />discipline and terminate heads of departments under hislher responsibilities, per proper and legal <br />processes, should he/she determine it to be necessary, and the City Commission desires to amend <br />the Charter to address these anomalies; and <br /> <br />WHEREAS, on January 22, 2007, during their regular City Commission Meeting, the <br />City Commission decided by consensus to add to the Ballot the question of whether the <br />electorate of the City wished to require each Commissioner and Mayor/Commissioner to be <br />elected by a majority of votes cast or 50% plus I; and <br /> <br />WHEREAS, changing from an election system requiring a simple majority of votes to <br />requiring a majority plus one may cause the need for a run-off election, which necessitates the <br />need for a change of election dates in the Charter; and <br /> <br />WHEREAS, Section 166.031, Florida Statutes, provides that the governing body of a <br />municipality may, by ordinance, submit to the electors of said municipality proposed <br />amendments to its Charter, which amendments may be to any part or all of its Charter except that <br />part describing the boundaries of such municipality; and <br /> <br />1 <br />
