<br />ORDINANCK NO. 724 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING ORDINANCE NO. 696, ARTICLE IV, REMOVAL OF CITY <br />MANAGER; PROVIDING FOR CODIFICATION, CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE. <br /> <br />BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. That Article IV of Ordinance No. 696 of the City Code of the <br /> <br />City of Casselberry, Florida, is hereby amended to read as follows: <br /> <br />ARTICLE IV. REMOVAL OF CITY MANAGER. <br /> <br />The City Commission may remove the city Manager from <br />office in accordance with the following procedures: <br /> <br />(a) The City Commission shall adopt by affirmative vote <br />of four of its members a preliminary resolution which <br />must state the reason for removal and may suspend the <br />City Manager from duty for a period not to exceed <br />forty-five (45) consecutive calendar days. A copy of the <br />resolution shall be delivered promptly to the City <br />Manager. <br /> <br />(b) Within five (5) days after a copy of the resolution <br />is delivered to the City Manager, the City Manager may <br />file with the Commission a written request for a public <br />hearing. This hearing shall be held at a duly noticed <br />Commission meeting not earlier than fifteen (15) days nor <br />more than thirty (30) days after the request is filed. <br />The City Manager may file with the City Commission a <br />written reply not later than five (5) days before the <br />public hearing. <br /> <br />(c) The Commission may adopt a final resolution of <br />removal, which may be made effective immediately, by <br />affirmative vote of four of its members at anytime after <br />five (5) days from the date when a copy of the <br />preliminary resolution was delivered to the city Manager, <br />if the City Manager has not requested a public hearing, <br />or at anytime after the public hearing if the City <br />Manager has requested a public hearing. <br />
