ORDINANCK NO. 724 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING ORDINANCE NO. 696, ARTICLE IV, REMOVAL OF CITY MANAGER; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. That Article IV of Ordinance No. 696 of the City Code of the City of Casselberry, Florida, is hereby amended to read as follows: ARTICLE IV. REMOVAL OF CITY MANAGER. The City Commission may remove the city Manager from office in accordance with the following procedures: (a) The City Commission shall adopt by affirmative vote of four of its members a preliminary resolution which must state the reason for removal and may suspend the City Manager from duty for a period not to exceed forty-five (45) consecutive calendar days. A copy of the resolution shall be delivered promptly to the City Manager. (b) Within five (5) days after a copy of the resolution is delivered to the City Manager, the City Manager may file with the Commission a written request for a public hearing. This hearing shall be held at a duly noticed Commission meeting not earlier than fifteen (15) days nor more than thirty (30) days after the request is filed. The City Manager may file with the City Commission a written reply not later than five (5) days before the public hearing. (c) The Commission may adopt a final resolution of removal, which may be made effective immediately, by affirmative vote of four of its members at anytime after five (5) days from the date when a copy of the preliminary resolution was delivered to the city Manager, if the City Manager has not requested a public hearing, or at anytime after the public hearing if the City Manager has requested a public hearing.
