Mrs. <br />McIntosh noted that one ofthe attachments to Mr. Wells' memorandum was her legal opinion on the matter. <br />Mrs. McIntosh further noted that the City Commission would only be reviewing facts and evidence that was <br />previously brought before the Planning & Zoning Commission. Mayor Pronovost and Commissioner <br />Sheppard announced that they had individually had brief conversations with Mr. Gerken and Mr. Phillips <br />regarding the matter. <br /> <br />Audience InDut: <br /> <br />]) Mr. Ron Phillips, 1158 Carmel Circle, #130, appellant, gave a history of the Carmel By <br />The Lake development and reiterated his and Mr. Allen's positions on the matter that were <br />presented to the Planning & Zoning Commission on March 22, 2000. (A copy of the <br />March 22, 2000 Planning & Zoning Commission meeting minutes are attached to and <br />made a part ofthese minutes.) In summary, Mr. Phillips stated they were advocating a two <br />building plan, but would compromise with a single building limited to 40 units. <br /> <br />2) Mr. Hank Gerken, I] 66 Carmel Circle, stated he was president of the Carmel <br />Homeowners Association, and reiterated his comments made to the Planning & Zoning <br />Commission at its March 22, 2000 meeting. Mr. Gerken further stated that the Board of <br />Directors now had all seven members in place and had unanimously approved the concept <br />of one building with 48 units. <br /> <br />3) Mr. Ben Shoemaker, Vice President ofR.P.L. Development, Inc., 1104 Stetson Street, <br />Orlando, stated his company was the contract purchaser of the subject property and <br />reiterated his positions on the matter that were presented to the Planning & Zoning <br />Commission on March 22, 2000. <br /> <br />MOTION: <br /> <br />Vice Mayor Clark moved to deny the appeal ofSPR 00- <br />03, Site Plan for seven-story condominium at Carmel <br />By The Lake and to affirm the approval of said site <br />plan made by the Planning & Zoning Commission at its <br />March 22, 2000 meeting. Motion was seconded by <br />Commissioner Henson. Motion carried unanimously <br />by voice vote. <br />
