<br />ORDINANCE NO. 95-820 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING CHAPTER 94 OF THE CODE OF ORDINANCES OF THE CITY OF <br />CASSELBERRY, FLORIDA, TO AMEND THE ANNUAL REGISTRATION FEE; <br />REGULATING THE SPEED OF BOATS AND PERSONAL WATERCRAFTS; <br />PROVIDING PENALTY FOR VIOLATION OF REGULATIONS; PROVIDING <br />FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE. <br /> <br />WHEREAS, the City Commission of the City of Casselberry, Florida, hereby finds that the use <br />of boats and personal watercraft has increased in the City over the past several years; and <br /> <br />WHEREAS, the City Commission of the City of Casselberry, Florida, wishes to ensure the safety <br />of the individuals participating in water activity on City lakes; and <br /> <br />WHEREAS, the City Commission finds that it is in the best interests of the health, safety, and <br />general welfare of the citizens of Casselberry, Florida, that all boats and personal watercraft operated <br />on the waters of the City of Casselberry be restricted by speed as to the hours of operation and as <br />to lake size; and <br /> <br />WHEREAS, the City Commission finds that the noise generated from the high speed operation <br />of boats and personal watercrafts on the waters of the City of Casselberry infringes upon the peace, <br />quiet, and tranquility of the surrounding neighborhoods; and <br /> <br />WHEREAS, the City Commission finds that boats and personal watercrafts can be dangerous <br />instrumentalities and that all operators shall exercise the highest degree of care to prevent injuries to <br />others and themselves; and <br /> <br />WHEREAS, the City Commission provides in ss Section 94-40 of the City Code for a no wake <br />or safety zone within one hundred (1001 feet of the shoreline of any body of water within the City; <br /> <br />WHEREAS, the City Commission of the City of Casselberry, Florida, finds that it is in the best <br />interests of the health, safety, and general welfare of the citizens of Casselberry that the registration <br />fee provision of the Code be amended to determine the ownership of all watercraft which operate on <br />the waters of the City of Casselberry and to aid in the advancement of water safety. <br /> <br />NOW THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF <br />THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. That Section 94-38 (a) (2) of the Casselberry City Code is hereby amended to read <br />as follows: <br /> <br />There shall be an annual fee set by the City Commission <br />per boat for boats used in conducting commercial operations <br />except fishing. The initial annual registration fee, if registration <br />is applied for after July 1 in any year, shall be $25.00 for <br />boats used in commercial operations except fishing, and the <br />registration fee for all other boats shall be: <br /> <br />a) Casselberry residents - <br />b) Non-residents- <br /> <br />$4.00 <br />$25.00 <br />
