ORDINANCE NO. 95-820 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING CHAPTER 94 OF THE CODE OF ORDINANCES OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE ANNUAL REGISTRATION FEE; REGULATING THE SPEED OF BOATS AND PERSONAL WATERCRAFTS; PROVIDING PENALTY FOR VIOLATION OF REGULATIONS; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City Commission of the City of Casselberry, Florida, hereby finds that the use of boats and personal watercraft has increased in the City over the past several years; and WHEREAS, the City Commission of the City of Casselberry, Florida, wishes to ensure the safety of the individuals participating in water activity on City lakes; and WHEREAS, the City Commission finds that it is in the best interests of the health, safety, and general welfare of the citizens of Casselberry, Florida, that all boats and personal watercraft operated on the waters of the City of Casselberry be restricted by speed as to the hours of operation and as to lake size; and WHEREAS, the City Commission finds that the noise generated from the high speed operation of boats and personal watercrafts on the waters of the City of Casselberry infringes upon the peace, quiet, and tranquility of the surrounding neighborhoods; and WHEREAS, the City Commission finds that boats and personal watercrafts can be dangerous instrumentalities and that all operators shall exercise the highest degree of care to prevent injuries to others and themselves; and WHEREAS, the City Commission provides in ss Section 94-40 of the City Code for a no wake or safety zone within one hundred (1001 feet of the shoreline of any body of water within the City; WHEREAS, the City Commission of the City of Casselberry, Florida, finds that it is in the best interests of the health, safety, and general welfare of the citizens of Casselberry that the registration fee provision of the Code be amended to determine the ownership of all watercraft which operate on the waters of the City of Casselberry and to aid in the advancement of water safety. NOW THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. That Section 94-38 (a) (2) of the Casselberry City Code is hereby amended to read as follows: There shall be an annual fee set by the City Commission per boat for boats used in conducting commercial operations except fishing. The initial annual registration fee, if registration is applied for after July 1 in any year, shall be $25.00 for boats used in commercial operations except fishing, and the registration fee for all other boats shall be: a) Casselberry residents - b) Non-residents- $4.00 $25.00
