ATTACHMENT B TEMPORARY ACCESS LICENSE FOR CONSTRUCTION OF ROUNDABOUT IMPROVEMENTS AT 11 JACKSON COURT, CASSELBERRY, FLORIDA This Temporary Access License Agreement ("License") is made and entered into this _ day of , 2007, by and between KAREN KILGANNON, ("GRANTOR"), with a mailing address of 461 NW 48'h Avenue, Ft. Lauderdale, Florida 33309, and CITY OF CASSELBERRY, a Florida municipal corporation ("GRANTEE") with offices at 95 Triplet Lake Drive, Casselberry, Florida 32707. RECITALS: GRANTOR is the owner in fee simple title of certain real property, described in Exhibit A and Exhibit 8, attached hereto and incorporated herein by reference (the "Kilgannon Parcels"), located at 11 Jackson Court, Casselberry, Florida, County of Seminole, State of Florida; and Pursuant to the terms and conditions of a land Purchase Agreement between GRANTOR and GRANTEE, (the "Kilgannon Parcels"), GRANTEE is obligated to construct the Triplet Lake Drive and US Hwy. 17/92 Intersection Improvements Project, (the "Projecf'), a public right of way, which is located adjacent to 11 Jackson Court and Melody Lane; and Due to the construction time schedule, it is important GRANTEE have the right under license to enter those portions of the Kilgannon Parcells) that are more particularly described in Exhibit A and Exhibit 8, attached hereto and incorporated herein by reference (the "License Area") to perform certain work associated with constructing the improvements for the Project; and GRANTOR is willing to allow GRANTEE to use the License Area prior to the closing of the Kilgannon Parcei(s) for the purpose of performing such work in accordance with the terms and conditions 01 this License so the Project may be completed. NOW THEREFORE, for and in consideration of the sum of Ten and 00/100 Dollars ($10.00) and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties hereto, do hereby covenant and agree as follows: 1. The foregoing recitals are true and correct, and are hereby incorporated herein and made a part of this License.
