<br />ATTACHMENT B <br /> <br />TEMPORARY ACCESS LICENSE <br />FOR CONSTRUCTION OF ROUNDABOUT IMPROVEMENTS AT <br />11 JACKSON COURT, CASSELBERRY, FLORIDA <br /> <br />This Temporary Access License Agreement ("License") is made and entered into this _ day of <br /> <br /> <br />, 2007, by and between KAREN KILGANNON, ("GRANTOR"), with a mailing <br /> <br /> <br />address of 461 NW 48'h Avenue, Ft. Lauderdale, Florida 33309, and CITY OF CASSELBERRY, a <br /> <br />Florida municipal corporation ("GRANTEE") with offices at 95 Triplet Lake Drive, Casselberry, Florida <br /> <br />32707. <br /> <br />RECITALS: <br /> <br />GRANTOR is the owner in fee simple title of certain real property, described in Exhibit A and <br /> <br />Exhibit 8, attached hereto and incorporated herein by reference (the "Kilgannon Parcels"), located at 11 <br /> <br /> <br />Jackson Court, Casselberry, Florida, County of Seminole, State of Florida; and <br /> <br />Pursuant to the terms and conditions of a land Purchase Agreement between GRANTOR and <br /> <br />GRANTEE, (the "Kilgannon Parcels"), GRANTEE is obligated to construct the Triplet Lake Drive and US <br /> <br />Hwy. 17/92 Intersection Improvements Project, (the "Projecf'), a public right of way, which is located <br /> <br />adjacent to 11 Jackson Court and Melody Lane; and <br /> <br />Due to the construction time schedule, it is important GRANTEE have the right under license to <br /> <br />enter those portions of the Kilgannon Parcells) that are more particularly described in Exhibit A and <br /> <br /> <br />Exhibit 8, attached hereto and incorporated herein by reference (the "License Area") to perform certain <br /> <br />work associated with constructing the improvements for the Project; and <br /> <br />GRANTOR is willing to allow GRANTEE to use the License Area prior to the closing of the <br /> <br />Kilgannon Parcei(s) for the purpose of performing such work in accordance with the terms and conditions <br />01 this License so the Project may be completed. <br /> <br />NOW THEREFORE, for and in consideration of the sum of Ten and 00/100 Dollars ($10.00) and <br /> <br />other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the <br /> <br />parties hereto, do hereby covenant and agree as follows: <br /> <br />1. The foregoing recitals are true and correct, and are hereby incorporated herein and made <br /> <br />a part of this License. <br />
