<br />RESOLUTION 07-1776 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />EXECUTION OF A PURCHASE AGREEMENT AND TEMPORARY ACCESS LICENSE <br />BETWEEN SIEBERT TRUST AND THE CITY OF CASSELBERRY; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />WHEREAS, the City of Casselberry desires to obtain two separate identified parcel(s) from <br />Siebert Trust, (via Fee Simple Warranty Deed), and a Temporary Construction Easement, located <br />at the intersection of Melody Lane and Jackson Court; and <br /> <br />WHEREAS, these two parcels are required for additional road right-of-way and <br />Temporary Construction Easement to construct the Melody Lane roundabout infrastructure <br />improvements and reconstruct the existing Siebert Trust driveway associated with the Triplet Lake <br />Drive and US Highway 17/92 Intersection Improvements Project; and <br /> <br />WHEREAS, Siebert Trust has agreed to provide a Temporary Access License to the City <br />of Casselberry, in order for the City to begin construction activities prior to the closing date for <br />acquiring said parcels; and <br /> <br />WHEREAS, City staff and the City Attorney have reviewed the Purchase Agreement and <br />Temporary Access License between Siebert Trust and the City of Casselberry and finds them <br />favorable to the City. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission of the City of Casselberry hereby approves the <br />agreement for the purchase of property and Temporary Access License between Siebert Trust <br />and the City of Casselberry (attached hereto as "Exhibits A and B"), and authorizes the Mayor to <br />execute said documents on behalf of the City. <br /> <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br /> <br />SECTION III. Severabilitv. If any Section or portion of a Section of this Resolution proves <br />to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, <br />force, or effect of any other Section or part of this Resolution. <br /> <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon its <br />passage and adoption. <br />
