RESOLUTION 07-1776 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE EXECUTION OF A PURCHASE AGREEMENT AND TEMPORARY ACCESS LICENSE BETWEEN SIEBERT TRUST AND THE CITY OF CASSELBERRY; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, the City of Casselberry desires to obtain two separate identified parcel(s) from Siebert Trust, (via Fee Simple Warranty Deed), and a Temporary Construction Easement, located at the intersection of Melody Lane and Jackson Court; and WHEREAS, these two parcels are required for additional road right-of-way and Temporary Construction Easement to construct the Melody Lane roundabout infrastructure improvements and reconstruct the existing Siebert Trust driveway associated with the Triplet Lake Drive and US Highway 17/92 Intersection Improvements Project; and WHEREAS, Siebert Trust has agreed to provide a Temporary Access License to the City of Casselberry, in order for the City to begin construction activities prior to the closing date for acquiring said parcels; and WHEREAS, City staff and the City Attorney have reviewed the Purchase Agreement and Temporary Access License between Siebert Trust and the City of Casselberry and finds them favorable to the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the agreement for the purchase of property and Temporary Access License between Siebert Trust and the City of Casselberry (attached hereto as "Exhibits A and B"), and authorizes the Mayor to execute said documents on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severabilitv. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and adoption.
