<br />AGREEMENT FOR PURCHASE AND SALE OF PROPERTY <br /> <br />THIS AGREEMENT for the Purchase and Sale of Property signed and entered into on the <br />/Ot!t day of ~-g , 2007, by and between SOUTH SEMINOLE LODGE NO. 364 <br />FREE AND ACCEPTED MASONS OF FLORIDA, (SELLER), with a mailing address of Post <br />Office Box 180364, Casselberry, Florida 32718-0364, and THE CITY OF CASSELBERRY, <br /> <br />(BUYER), a Florida Municipal Corporation, 95 Triplet Lake Drive, Casselberry, FL 32707. <br /> <br />In lieu of condemnation and eminent domain proceedings regarding the acquisition of <br /> <br />required real property for the Triplet Lake Drive and US Hwy. 17/92 Intersection Improvements <br /> <br />Project, (Project), the parties hereby agree that the Seller shall sell and the Buyer shall buy the <br /> <br />lands described as the Masonic Lodge Parcel, Exhibit "A", attached hereto and incorporated <br /> <br />herein by reference, in Fee Simple by Warranty Deed attached hereto and incorporated herein by <br /> <br />reference, for the following to be performed by THE CITY OF CASSELBERRY at the City's sole <br /> <br />cost and expense: <br /> <br />1. As part of the Triplet Lake Drive and US Hwy. 17/92 Intersection Improvements <br />Project, the City and/or its agents, (I.e., General Contractor, sub-contractor, engineers, surveyors, <br />etc.), shall construct the infrastructure improvements associated with the new roundabout, located <br />at Triple Lake Drive and Quail Pond Circle. <br /> <br />2. City and/or its agents, (I.e., General Contractor, sub-contractor, surveyors, <br />engineers, etc.), shall provide ingress/egress to the remainder property at all times during <br />construction of the infrastructure improvements associated with the roundabout at Triplet Lake <br />Drive and Quail Pond Circle. <br /> <br />3. The remainder property shall benefit from provisions of the City's Unified Land <br />Development Regulations that state the properties which have portions taken and/or used for City <br />road projects are not strictly subject to setback requirements and other requirements, as set forth <br />in the Unified Land Development Regulations. As such, the City shall permit the SELLER's use of <br />the remainder property parking spaces be allowed to continue as a non-conforming use in the <br />after situation, as a result of the roundabout infrastructure improvements constructed for the <br />Project. This shall in no way be construed as a land use approval. <br /> <br />BUYER agrees to pay all closing costs including title insurance and documentary stamps <br />on the Deeds.
