<br />City Commission Meeting <br />March 12, 2007 <br />Page 4 <br /> <br />Staff Presentation: This is the second Public Hearing for Resolution 07-1767, which designates property <br />located at I 150 Belle Avenue, Casselberry, Florida as a Brownfield Property. The Brownfield designation <br />will allow an agreement between Saticoy Investments, Company, LLC and the Florida Department of <br />Environmental Protection to establish environmental remediation ofthe property and allow redevelopment <br />and reuse of the site and also provides the owner access to numerous opportunities for financial assistance <br />for rehabilitation of the site. The Brownfield designation for this property poses no financial obligation <br />for the City. <br /> <br />Staff Recommendation: The City Attorney has reviewed and approved Resolution 07-1767 and staff <br />recommends approval. <br /> <br />MOTION: <br /> <br />Moved by Commission Susan Doerner to approve Resolution 07-1767, <br />Brownfield Designation for property at 1150 Belle Avenue, as presented. <br />Motion was seconded by Commissioner Colleen S. Hufford and carried on <br />a5-0vote. <br /> <br />B. BA 07-01 Robert Sabrkhani, 500 State Road 436, Regency Square - Variance Request <br />from Distance Separation Between Bars/Lounges <br /> <br />Staff Presentation: This item is a variance request for a distance separation between two businesses <br />selling alcoholic beverages. The variance request from Robert Sabrkhani, property owner of the Regency <br />Square Shopping Center, to allow a 131 foot distance separation from the Holly and Dolly's Bar, in lieu <br />ofthe 1,000 foot requirement as stipulated in ULDR Section 1-2.7. The requested variance site has been <br />a restaurant serving alcoholic beverages since 1995 and due to a fire and time required to settle insurance <br />matters, the previous tenant went out of business. Mr. Sabrkhani, the present tenant was present and <br />addressed the Commission in support of the variance request. <br /> <br />Staff Recommendation: A conditional use approval of the variance request of 13 I feet rather than the <br />required 1,000 foot distance separation between bars and lounges. <br /> <br />MOTION: <br /> <br />Moved by Commissioner Colleen S. Hufford to approve BA 07-01, Variance <br />Request from Robert Sabrkhani, including fact findings and conclusion of <br />law and staff recommendation as presented. Motion was seconded by <br />Commissioner Sandra T. Solomon and carried on a 5 - 0 vote. <br /> <br />AMENDED <br />MOTION: <br /> <br />Moved by Commissioner Colleen S. Hufford that motion also include that <br />the sale of alcoholic beverages must be less than 50% of the gross sales <br />receipts.
