<br />RESOLUTION 06-1687 <br /> <br />A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING <br />THE MAYOR TO EXECUTE THE SECOND AMENDMENT TO CONCEPTUAL <br />PLAN AGREEMENT, BETWEEN THE CITY AND UNICORP NATIONAL <br />DEVELOPMENTS, INC.; PROVIDING FOR CONFLICTS, SEVERABILITY, <br />AND EFFECTIVE DATE. <br /> <br />WHEREAS, the City Commission of the City of Casselbeny and the City's Community <br />Redevelopment Agency has previously approved the sale of certain property owned by the City to Unicorp <br />National Developments, Inc. ("Unicorp"); and <br /> <br />WHEREAS, the City Commission of the City of Casselbeny by Resolution 06-1652, approved the <br />Conceptual Plan Agreement for the property; and <br /> <br />WHEREAS, the City Commission of the City of Casselbeny by Resolution 06-1673-B, approved <br />the First Amendment to the Conceptual Plan extending the same deadlines associated herewith; and <br /> <br />WHEREAS, Unicorp has requested another extension of I) the date for the execution of a "Water <br />Retention Area Construction and Joint Utilization Agreement and Cross Grant of Easements," and 2) the <br />date for submittal of the preliminary site plan and plat. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission of the City of Casselbeny hereby approves the Second <br />Amendment to the Conceptual Plan Agreement attached hereto as Exhibit "A," and authorizes the Mayor to <br />execute said Second Amendment to Conceptual Plan Agreement on behalf of the City. <br /> <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br /> <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be <br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect <br />of any other Section or part of this Resolution. <br /> <br />SECTION IV. Effective Date.
