<br />after purchasing the Property, including, but not limited to: <br /> <br />a. New blacktop and additional paving; <br /> <br />b. New valance in front of the building to give an appearance of a professional <br /> <br />office park; <br /> <br />c. Name change of the office park to "Lee's Cove Park"; <br /> <br />d. Landscaping the area in front of the building with trees and shrubs; <br /> <br />e. Side yard and back yard clean up of any visual discrepancies, and future <br /> <br />enforcement of a policy of outside cleanliness; <br /> <br />f. Painting the entire building; <br /> <br />g. Solid fencing in a decorative style to separate the contiguous properties. <br /> <br />All of the above and any other improvements shall be a part of an approved site plan and shall be in <br /> <br />accordance with all City Codes. <br /> <br />5. Upon payment of said sums, the CITY shall release the two (2) code enforcement <br /> <br />liens and file said releases upon the public records of Seminole County, Florida, and shall file a <br /> <br />dismissal of the Lawsuit, and release of the defendants in the Lawsuit. <br /> <br />6. Each of the signatories hereto represents and warrants that he, she or it and the party <br /> <br />on behalf of which such signatory has signed below has full power and authority to enter into this <br /> <br />Agreement. <br /> <br />7. In the event it becomes necessary to construe or enforce any provision of this <br /> <br />Agreement, the prevailing party shall be entitled to recover from the other party its reasonable <br /> <br />attorney's fees and costs, which shall include attorney's fees incurred at both the trial and appellate <br /> <br />levels and subsequent to the entry of a judgment should a jUdgment be placed with an attorney for <br /> <br />3 <br />
