<br />RESOLUTION 06-1665 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />EXECUTION OF AMENDMENT NO.1 TO SUPPLEMENTAL AGREEMENT NUMBER 3 <br />TO THE CONTINUING SERVICES CONTRACT FOR ADDITIONAL SURVEY, <br />GEOTECHNICAL EVALUATIONS AND TRANSPORTATION ENGINEERING <br />SERVICES WITH TRANSPORTATION ENGINEERING, INC. D/B/A TEl, FOR DESIGN <br />OF THE RE-ALlGNMENT OF NORTH WINTER PARK DRIVE; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />WHEREAS, on March 25, 2002, the City Commission approved a Continuing Services <br />Contract for transportation engineering services with Transportation Engineering, Inc. (TEl); and <br /> <br />WHEREAS, the City of Casselberry wishes to re-align and upgrade North Winter Park <br />Drive between Seminola Boulevard and State Road 434; and <br /> <br />WHEREAS, property acquisition negotiations for additional stormwater retention ponds <br />and extension of the proposed sanitary sewer system necessitates additional surveying, <br />geotechnical evaluations and design services beyond the initial scope; and <br /> <br />WHEREAS, the City staff has received proposed Amendment No. 1 to Supplemental <br />Agreement No. 3 from TEl for additional surveying and design services in the amount of <br />$54,386.99 and recommends that the City of Casselberry approve said Amendment. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission of the City of Casselberry hereby approves the <br />Amendment No. 1 to Supplemental Agreement NO.3 from TEl (attached hereto as "Attachment <br />A"), and authorizes the Mayor to execute said document on behalf of the City. <br /> <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br /> <br />SECTION III. Severabilitv. If any Section or portion of a Section of this Resolution proves <br />to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, <br />force, or effect of any other Section or part of this Resolution. <br /> <br />SECTION IV. Effective Date.
