Reischmann <br />Stenstrom, Mcintosh, et at. <br />1001 Heathrow Park Lane <br />Suite 4001 <br />Lake Mary, Florida 32746 <br /> <br />DRAINAGE EASEMENT AGREEMENT <br />THIS DRAINAGE EASEMENT (the "Drainage Easemenf'), is made and entered into this /3t! <br />of m/i..~ ,2006, and by and between CITY OF CASSEL~ERRY, FLORIDA, a <br /> <br />day <br /> <br />municipal corporation organized and existing under the laws of the State of Florida, whose post office <br /> <br />address is 95 Triplet Lake Drive, Casselberry, Florida, 32707-3399, hereinafter referred to as GRANTOR, <br /> <br />and ANCHOR ROAD COMMERCE CENTER, LLC, a Florida limited liability company, whose post <br /> <br />office address is 549 Wymore Road, Suite 106, Maitland, Florida 32751, hereinafter referred to as <br /> <br />GRANTEE. <br /> <br />WHEREAS, GRANTOR is the record owner of fee simple title to that certain parcel of real property <br /> <br />located in the City of Casselberry, more particularly described on Exhibit "A" attached hereto (hereinafter <br /> <br />referred to as the "Easement Area"); and <br /> <br />WHEREAS, GRANTOR and GRANTEE's predecessor in title, Harold Decker, entered into a <br /> <br />Stipulation and Settlement Agreement in State of Florida Department of Administrative Hearings Case No. <br /> <br /> <br />97-0816, and a Modified Stipulation and Settlement Agreement dated March 8,1999, and an Addendum to <br /> <br /> <br />Modified Stipulation and Settlement Agreement dated April 16, 1999 (the "Settlement Agreemenf'); and <br /> <br />WHEREAS, GRANTEE, as successor in interest to Harold Decker, hereby attests that it has <br /> <br />authority to sign this Drainage Easement in partial fulfillment of the terms of that Settlement Agreement; <br /> <br />and <br /> <br />WHEREAS, GRANTEE affirms that this Drainage Easement fulfills the requirement set forth in <br />paragraph 2 of the April 16, 1999 Addendum to the Settlement Agreement; and <br />WHEREAS, in accordance with the Settlement Agreement, GRANTOR desires to grant and <br /> <br />convey unto GRANTEE a non-exclusive Drainage Easement to, over, under, upon, across and through the <br />Page 1 of5 <br />
