<br />EX h, "b..-t. <br />.' fl" <br /> <br />CITY OF CASSELBERRY <br />CONCEPTUAL PLAN AGREEMENT <br /> <br />L' <br /> <br /> <br />/1 ,Arf/ <br />THIS CONCEPTUAL PLAN AGREEMENT is entered into as of the ...1, ('/' day of <br />,2006, by and between UNICORP NATIONAL DEVELOPMENTS, <br />rporation, ("UNICORP") and CITY OF CASSELBERRY, a Florida municipal <br />TY"). <br /> <br />WHEREAS, the City of Casselberry owns the property generally located at the <br />intersection of U.S. Highway 17-92 and Triplet Lake Drive and described in Exhibit A and <br />property previously owned by Casselberry Investment Properties, and formerly the Shell Station <br />(the "Property"); and <br /> <br />WHEREAS, in June 2004, the City issued a Request for Proposal for the sale of the <br />Property to a developer for the construction of a City Center Project (the "Project") on the which <br />would blend commercial and/or office and administrative uses, in both concept and architectural <br />form; and <br /> <br />WHEREAS, UNICORP submitted the only responsive and responsible response on <br />Augustl2,2004;and <br /> <br />WHEREAS, UNICORP has agreed to purchase the Property from the City; and <br /> <br />WHEREAS, the CITY and UNICORP desire to enter into this Conceptual Plan <br />Agreement, to set the development standards for the Project; and <br /> <br />WHEREAS, the City Commission deems the sale and development of this Property to be <br />a proper public purpose, and that said sale and development will achieve important City <br />objectives, such as stimulating economic development in the City and increasing property values, <br />and declares that the Property is surplus real property; and <br /> <br />WHEREAS, UNICORP is required, as a part of the City Center Project, to build a <br />stormwater system, and has agreed to upsize that stormwater system to also handle the run-off <br />from the CITY's adjacent rights-of-way, including the Triplet Lake Drive/Melody Lane re- <br />alignment; and <br /> <br />WHEREAS, the CITY hereby finds a public purpose for UNICORP to build said <br />stormwater system and be responsible for maintenance of said stormwater system, and for the <br />CITY to share a portion of the system that is necessitated by the CITY's Triplet Lake <br />Drive/Melody Lane re-alignment; and <br /> <br />WHEREAS, the City Commission is authorized to enter into this Conceptual Plan <br />Agreement pursuant to its home rule authority; and <br /> <br />WHEREAS, the City Commission hereby finds that this Agreement is consistent with its <br />Comprehensive Plan, and is in the best interests of the citizens; and <br /> <br />I <br />
