<br />6.8 Nothing herein shall prevent the Department from suspending a Lieutenant with pay <br />pending an inquiry or investigation. <br /> <br />6.9 The findings of internal affairs investigations shall be labeled "sustained" (charges <br />supported by competent evidence) or "unfounded" (not supported by competent evidence) or <br />"exonerated" (act was justifiable/excusable). No other terminology may be used. <br /> <br />6.10 If no other disciplinary proceedings have been commenced against a Lieutenant during <br />the below listed periods, disciplinary action shall not form the basis for subsequent disciplinary <br />or promotional decisions in accordance with the following: <br /> <br />A. Written Reprimand after one (1) year <br />B. Demotion can always used; <br />C. Suspension without pay can always used. <br /> <br />6.11 The charges "conduct unbecoming an officer", "incompetence" and "carelessness", must <br />contain the specific detail of the charged conduct. <br /> <br />6.12 Any Lieutenant who is suspended will have the choice between taking actual days off <br />without payor having time deducted from vacation or compensatory time. <br /> <br />8 <br />
