<br />agreements, amendments of the Unified Land Development Regulations, and developer's agreements <br />require review by the City Attorney to determine legal compliance with Federal, State, County and <br />jurisdictional requirements, and the existing fee schedule should be amended to provide for reimbursement <br />of legal fees for the City Attorney's review of proposals for subdivision plats, site development, planned unit <br />development, and administrative appeals; and <br />WHEREAS, staff provides customer services that utilize City staff time, equipment and materials <br /> <br />for which the applicant should reimburse the City, which services include approval of alcoholic beverage <br /> <br />license applications, flood zone determination letters, administrative official determination of a code <br /> <br />requirement, copying tapes, and staff research for information requests; and <br /> <br />WHEREAS, the City Commission desires to repeal Resolutions 94-869, 05-1574, and all amending <br /> <br />resolutions and replace the fee schedule in those Resolutions with Exhibit "A" attached hereto, to include <br /> <br />additional staff expenses and provide comparable development fees. <br /> <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA: <br /> <br />SECTION 1. ESTABLISHMENT OF FEE SCHEDULE. Fees for development review by the <br />Development Review Committee, Planning and Zoning Commission, the Board of Adjustment and City <br />Commission, appeal fees, arbor permits, and other related fees are hereby established in accordance with <br />the fee schedule attached as Exhibit A as authorized by Sec. 1-2.8 of the City's Unified Land Development <br />Regulations. <br />SECTION 2. ADMINISTRATION. Each application for development review, appeals, and arbor <br /> <br />permits and other related matters shall be submitted to the Community Development Department <br /> <br />accompanied by a check, made payable to the City of Casselberry. <br /> <br />SECTION 3. WAIVER OF FEES. A waiver of the application fee may be approved by the City <br /> <br />Commission for public, semi-public and not-for-profit entities performing administrative services as defined <br /> <br />by Sec. 5-21.2 of the Unified Land Development Regulations. Fee waiver applications, including a <br /> <br />demonstration of need for the fee waiver, shall be submitted to the Community Development Director, who <br /> <br />Ordinance No. 06-1642 <br />Page 2 of 3 <br />
