to file suit thereon and to collect all such unpaid fees and interest, including actual <br />attorney's fees and costs of the litigation. <br /> <br /> § 5~..60 CRIgDITS FOR ON-SITE STORM~IATIgR MANAGIgMENT <br /> FACILITIIgS. <br /> <br />Credits for on-site stormwater management facilities shall be allowed and <br />calculated as follows: <br /> <br /> (A) In order to encourage a reduction in stormwater runoff and improvement <br />of the quality of stormwater runoff, a credit against the stormwater and lake <br />management utility fee is authorized for those developed properties which are <br />addressed by a stormwater retention facility designed and constructed for the <br />purpose of stormwater flow mitigation and pollution reduction if it meets defined <br />standards. Detention facilities are not eligible for credit. <br /> <br /> (B) A reduction in a stormwater fee may be allowed for a particular property <br />only if the stormwater runoff from the property is served by a stormwater <br />management facility that has been designed, constructed and is maintained properly <br />for the purpose of stormwater flow mitigation and pollution reduction as measured <br />against a defined standard established by the City. To be eligible for the <br />stormwater retention credit, the facility must be constructed, owned, operated, and <br />maintained by other than the City. The facility must also be on land owned by other <br />parties than the City and upon which there are no drainage easements dedicated to <br />the public for the general purposes of drainage retention, flow mitigation, or <br />stormwater pollution abatement. <br /> <br /> (C) For applicable properties, a credit may be calculated and the fee may <br />be reduced based upon defined standards and a formula the City Commission may <br />establish by Resolution from time to time. No property shall have a verified right <br />to the use of any particular formula or fee reduction other than that established by <br />the City Commission by Resolution.
