CASSELBERRY CITY COMMISSION <br />Minutes of May 24, 2004 - Regular Meeting <br />Page 2 of 13 <br /> <br />The City Clerk read Ordinance 04-1130 by title as follows: <br /> <br />"AN ORDiNANCE OF THE CITY OF CASSELBERRY, FLORIDA, RELATiNG TO <br />ANNEXATION; MAKiNG FINDiNGS; ANNEXING TO AND INCLUDING WITHIN <br />THE CORPORATE LIMITS OF THE CITY OF CASSELBERRY, FLORIDA, CERTAIN <br />LANDS LOCATED IN SECTION 22, 27 AND 34, TOWNSHIP 21S, RANGE 30E, <br />REDEFINING THE CORPORATE LIMITS OF THE CITY OF CASSELBERRY, <br />FLORIDA; PROVIDING FOR THE INTERIM PROVISION OF LAND DEVELOPMENT <br />REGULATIONS; PROVIDING THAT CERTAIN COUNTY LICENSEES FOLLOWING <br />THEIR BUSINESS, TRADE OR PROFESSION WITHIN THE LANDS TO BE <br />ANNEXED MAY CONTINUE TO FOLLOW SUCH BUSINESS, TRADE OR <br />PROFESSION THROUGHOUT THE ENTIRE CORPORATE LIMITS WITHOUT THE <br />NECESSITY OF FURTHER QUALIFICATION THEREFORE; PROVIDING THAT THE <br />LANDS TO BE ANNEXED SHALL BE ASSESSED FOR PAYMENT OF MUNICIPAL <br />AD VALOREM TAXES PURSUANT TO LAW; PROVIDiNG FOR SUBMISSION OF <br />THE QUESTION OF ANNEXATION OF SAID LANDS INTO THE CITY OF <br />CASSELBERRY AND WITHIN THE LANDS TO BE ANNEXED AT AN ELECTION TO <br />BE HELD JULY 13, 2004; PROVIDING FOR A POLLING PLACE AND A <br />CANVASSiNG BOARD; DIRECTING THE CITY CLERK TO FILE CERTIFIED COPIES <br />OF THE ORDINANCE WITH THE CLERK OF COURT AND THE SECRETARY OF <br />STATE OF THE STATE OF FLORIDA; AND PROVIDING FOR CODIFICATION, <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />Legal Advertisement: The Notice of Public Hearing relative to Ordinance 04-1130 was published in the <br />Orlando Sentinel on April 29, 2004 and May 13, 2004. <br /> <br />Staff Presentation: Mr. Clifton distributed an inter-office memorandum dated May 20, 2004 to the City <br />Commission outlining the events that have occurred since the May 10, 2004 City Commission and options <br />available with regard to the San Pedro annexation. A copy of Mr. Clifton's May 20, 2004 inter-office <br />memorandum is attached to and made a part of these minutes. Mr. Clifton discussed the various <br />elements of the inter-office memorandum. Mr. Clifton recommended tabling the public hearing and second <br />reading of Ordinance 04-1130 in the spirit of cooperation until dispute resolution meetings with Seminole <br />County took place. Mr. Clifton noted if Ordinance 04-1130 was tabled, and then adopted at a later date, the <br />earliest the referendum could occur most likely would be December 7, 2004. The City Clerk's Office will <br />notify the City Commission in the event it is determined the referendum could be held prior to December 7, <br />2004. <br /> <br />Commission Discussion: Discussion ensued regarding the meeting that occurred on May 17, 2004 between <br />City staff, County staff and attorneys for the Orlando Catholic Diocese, as well as the options available to <br />the City Commission on how to proceed with Ordinance 04-1130. It was noted the two main objections that <br />have been raised by Seminole County are whether the annexation creates an enclave and impacts on County <br />services. It was further noted that the Seminole County Commission Chairman indicated that the County <br />would not be opposed to any voluntary annexations made by the City. Commission consensus was to table <br />the matter to demonstrate good faith toward Seminole County. <br /> <br /> <br />
