RESOLUTION 24-3412 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />CITY MANAGER TO EXECUTE AMENDMENT 92 TO THE <br />AGREEMENT WITH THE NATURAL RESOURCES CONSERVATION <br />SERVICE FOR GEE CREEK AND HOWELL CREEK EROSION <br />CONTROL DUE TO HURRICANE IAN; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry experienced significant erosive damage within the <br />Gee Creek and Howell Creek drainage basins as a result of Hurricane Ian in September 2022; <br />and <br />WHEREAS, the City Commission authorized City staff to submit an application to the <br />United States Department of Agriculture Natural Resources Conservation Service (USDA <br />NRCS) in an effort to obtain additional grant to help fund improvements needed to address the <br />aforementioned damage; and <br />WHEREAS, the USDA NRCS agreed to award the City funding to assist with the <br />erosion control in Gee Creek and Howell Creek basins via a Cooperative Agreement; and <br />WHEREAS, due to higher than expected project costs, the USDA NRCS has since <br />agreed to award the City additional funding to assist with the erosion control in Gee Creek and <br />Howell Creek basins via Amendment #2 to the aforesaid Agreement; and <br />WHEREAS, said Amendment #2 will provide for a total revised amount of financial <br />assistance not to exceed $812,830.49 ($727,830.49 for construction and $85,000.00 for technical <br />assistance), and a required 25% construction funding match (or $242,610.16) from the City; and <br />WHEREAS, in order to avoid project delay, City staff recommends authorization for the <br />City Manager to execute the Amendment #2 document on behalf of the City after it is received <br />from USDA NRCS. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves and <br />authorizes the City Manager to execute on behalf of the City Amendment #2 to the Agreement <br />with the United States Department of Agriculture Natural Resources Conservation Service for <br />Gee Creek and Howell Creek Erosion Control due to Hurricane Ian, for a total financial <br />assistance amount not to exceed $812,830.49. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />
