RESOLUTION 20-3161 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AUTHORIZING AND GRANTING AN <br />EASEMENT TO DUKE ENERGY FLORIDA, LLC FOR NEW <br />ELECTRICAL FACILITIES AT THE HUNTERFIELD WATER TOWER <br />PROPERTY; PROVIDING FOR CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry owns the Hunterfield Water Tower property located <br />at 2231 Hunterfield Road, Maitland, FL 32751; and <br />WHEREAS, the Hunterfield Water Tower has not been in service for several years and is <br />in disarray; and <br />WHEREAS, the City is working to remove the water tower and other on-site <br />infrastructure; and <br />WHEREAS, active overhead powerlines currently prohibit the safe removal of the water <br />tower without affecting the surrounding neighborhood; and <br />WHEREAS, in order to prevent a wide -spread power outage in the surrounding <br />neighborhood, Duke Energy will need to reroute electrical facilities underground; and <br />WHEREAS, an Easement will allow Duke Energy to reroute the electrical lines <br />underground across the City's property and will provide future access to the site for operation and <br />maintenance; and <br />WHEREAS, City staff has reviewed the Easement and finds it favorable to meet the needs <br />of the City. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the <br />Easement to Duke Energy Florida, LLC for the rerouting of new electrical facilities underground at <br />the Hunterfield Water Tower property, attached herewith, and authorizes the Mayor to execute said <br />document on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />
