RESOLUTION 20-3161 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING AND GRANTING AN EASEMENT TO DUKE ENERGY FLORIDA, LLC FOR NEW ELECTRICAL FACILITIES AT THE HUNTERFIELD WATER TOWER PROPERTY; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City of Casselberry owns the Hunterfield Water Tower property located at 2231 Hunterfield Road, Maitland, FL 32751; and WHEREAS, the Hunterfield Water Tower has not been in service for several years and is in disarray; and WHEREAS, the City is working to remove the water tower and other on-site infrastructure; and WHEREAS, active overhead powerlines currently prohibit the safe removal of the water tower without affecting the surrounding neighborhood; and WHEREAS, in order to prevent a wide -spread power outage in the surrounding neighborhood, Duke Energy will need to reroute electrical facilities underground; and WHEREAS, an Easement will allow Duke Energy to reroute the electrical lines underground across the City's property and will provide future access to the site for operation and maintenance; and WHEREAS, City staff has reviewed the Easement and finds it favorable to meet the needs of the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the Easement to Duke Energy Florida, LLC for the rerouting of new electrical facilities underground at the Hunterfield Water Tower property, attached herewith, and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
