RESOLUTION 20-3189 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING <br />THE EXECUTION OF AN EXCLUSIVE FRANCHISE <br />AGREEMENT FOR COMMERCIAL SOLID WASTE SERVICES <br />WITH WCA OF FLORIDA, LLC FOR FRANCHISE 1 <br />(FRONTLOAD DUMPSTER, CART, COMPACTOR, AND <br />OTHERWISE PUTRESCIBLE SOLID WASTE); PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, via Ordinance 20-1534, the City of Casselberry is transitioning to an exclusive <br />franchise system for commercial solid waste service; and <br />WHEREAS, on June 9, 2020, the City posted the solicitation RFP -2020-0636 Commercial <br />Solid Waste Services in order to solicit proposals for the exclusive franchise system; and <br />WHEREAS, consistent with Ordinance 20-1534, RFP -2020-0636 covered two exclusive <br />franchises: Franchise 1 (Frontload Dumpster, Cart, Compactor, and Otherwise Putrescible Solid <br />Waste) and Franchise 2 (Open -Top Roll -Off Containers for Non-Putrescible Solid Waste); and <br />WHEREAS, eight firms submitted proposals in response to RFP -2020-0636, and as a result <br />of the evaluation process, WCA of Florida, LLC was ranked highest and recommended for award <br />of Franchise 1; and <br />WHEREAS, the City has prepared and WCA of Florida, LLC has executed an exclusive <br />Agreement to provide commercial solid waste services under Franchise 1; and <br />WHEREAS, City staff has reviewed the proposed Agreement and finds it favorable to meet <br />the needs of the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the <br />exclusive franchise Agreement with WCA of Florida, LLC, attached herewith, to provide <br />commercial solid waste services under Franchise 1 and authorizes the Mayor to execute said <br />document on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution proves <br />to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, <br />force, or effect of any other Section or part of this Resolution. <br />
