RESOLUTION 20-3165 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, RECOGNIZING AND CONFIRMING <br />LEGISLATION IN PROGRESS REGARDING AMENDMENTS TO <br />ARTICLE III, DEVELOPMENT AGREEMENTS, TO AMEND THE <br />REVIEW PROCESS AND PROVIDE UPDATES CONSISTENT WITH <br />CURRENT STATE STATUTES; SECTION 2-5.4, SIZE AND DIMENSION <br />CRITERIA, TABLE 2-5.4 TO AMEND SIZE AND DIMENSION <br />CRITERIA RELATED TO THE PRD, PMX-L, PMX-H, PMX-MID, PMX- <br />HIGH, AND RMHP ZONING DISTRICTS; AND CHAPTER IV, <br />SPECIFIC DEVELOPMENT PROCEDURES, TO REPEAL AND <br />REPLACE ARTICLE XX, PLANNED UNIT DEVELOPMENT, WITH <br />NEW GENERAL REGULATIONS, APPLICATION AND CONCEPT <br />PLAN REQUIREMENTS, PLANNED UNIT DEVELOPMENT <br />AGREEMENT REQUIREMENTS, AND REVIEW AND APPROVAL <br />PROCEDURES; PROVIDING FOR LEGISLATIVE FINDINGS; <br />RECOGNIZING LEGISLATION IN PROGRESS; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry continuously monitors and reviews the Code of <br />Ordinances and the Unified Land Development Regulations to ensure appropriate regulations for <br />development and zoning within the City, and from time to time recognizes the need to study and <br />amend aspects of same; and <br />WHEREAS, the City Commission adopted Resolution 20-3148 on February 10, 2020, <br />which confirmed legislation in progress regarding amendments to Article XX, Planned Unit <br />Development, amendments to Section 2-5.4, Table 2-5.4, and amendments to Section 2-7.21; and <br />WHEREAS, upon further review by the staff of the City of Casselberry, additional <br />amendments to the Unified Land Development Regulations are necessary in order to provide a <br />systematic approach to planned unit development (PUD) zoning and development agreements; <br />and <br />WHEREAS, the City of Casselberry has identified discrepancies and inefficiencies <br />within Article III, Section 2-5.4, and Article XX that require immediate corrective action; and <br />WHEREAS, the City of Casselberry desires to provide clear and concise requirements <br />and direction to developers wishing to commence the development agreement and PUD zoning <br />process; and <br />WHEREAS, the City Commission and staff of the City of Casselberry have noted the <br />potential for future PUD zoning amendments and that time is needed to review, consider, and <br />modify the processes for adoption and implementation of regulations pertaining to development <br />agreements and planned unit developments, and to evaluate compliance with State law; and <br />
