RESOLUTION 20-3163 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING EXECUTION OF AN AGREEMENT FOR GOLF COURSE MANAGEMENT SERVICES BETWEEN THE CITY OF CASSELBERRY AND CYPRESS GOLF MANAGEMENT, LLC; PROVIDING FOR CONFLICTS, SEVERABILITY AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in 2015, the City of Casselberry ("City") purchased real property commonly known as Casselberry Golf Club; and WHEREAS, the City recognizes the benefit of engaging a third party management company to manage the affairs of the golf course operations; and WHEREAS, in 2015, the City advertised a solicitation for golf course management services; and WHEREAS, the City Commission approved a Golf Course Management Contract with Integrity Golf Company, LLC via Resolution 15-2738 on June 8, 2015; and WHEREAS, the Citv approved an assignment of the contract to Cypress Golf Management, LLC via Amendment #2 on August 1, 2017; and WHEREAS, the City desires to continue to utilize the services and expertise of Cypress Golf Management, LLC for the management and operation of the Casselberry Golf Club golf course and has negotiated a new Agreement with modified terms. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA AS FOLLOWS: SECTION I. The Agreement with Cypress Golf Management, LLC for Golf Course Management Services is hereby approved, and the City Commission authorizes the Mayor to execute said Agreement, attached hereto, on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any section, subsection, sentence, clause, phrase, word or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto.
