ORDINANCE 17-1459 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING SECTION 2-7.9, ACCESSORY STRUCTURES, OF THE CITY CODE OF ORDINANCES, PART IH, UNIFIED LAND DEVELOPMENT REGULATIONS, TO ADD LANGUAGE TO ALLOW ACCESSORY STRUCTURES IN EASEMENTS; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City of Casselberry finds that accessory structures in easements should be permissible when certain criteria are met; and WHEREAS, the existing language in Section 2-7.9, Accessory Structures, of the City Code of Ordinances, Part III, Unified Land Development Regulations, prohibits accessory structures in easements; and WHEREAS, to better serve the needs of City residents, it has been determined that such structures be allowed in easements where utilities and other stakeholders provide letters of no objection; and WHEREAS, the City's Planning and Zoning Commission (P&Z), sitting as the Land Planning Agency, has reviewed this Ordinance and finds it is consistent with the Comprehensive Plan; and WHEREAS, words with double underlined type shall constitute additions to the original text and strike thfough shall constitute deletions to the original text, and asterisks (* * *) indicate that text shall remain unchanged from the language existing prior to adoption of this Ordinance. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION 1. Section 2-7.9, Accessory Structures, of Chapter II, Article VII, General Regulations, of the Code of Ordinances, Part III, Unified Land Development Regulations, is hereby amended to read as follows: Section 2-7.9. — Accessory strlactures. A. General requirements. Accessory structures must be constructed simultaneously with, or following, the construction of the principal structure and shall not be used until after the principal structure has been fully erected.
