RESOLUTION 04-1493 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING CATHCART CONTRACTING COMPANY TO PROVIDE MISCELLANEOUS DRAINAGE PROJECT CONSTRUCTION SERVICES FOR THE CITY OF CASSELBERRY; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, the City of Casselberry has undertaken to improve, repair and/or replace drainage infrastructure in various locations throughout the City; and WHEREAS, the City of Casselberry advertised for bids for the Miscellaneous Drainage project; and WHEREAS, on April 28, 2004, the City received two (2) sealed bids; and WHEREAS, the City staff has reviewed the bid proposal contract of Cathcart Contracting Company and found it complete, competitive and adequate for the project and recommends approval. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the agreement with Cathcart Contracting Company (attached as "Exhibit A"), and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions ~n conflict with any of the provisions of this Resolution are hereby repealed. SECTION IlL Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, fome, or effect of any other Section or part of this Resolution. SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and adoption. PASSED and ADOPTED this /z~ day of ~'~.,..-. , AD 2004.
