RESOLUTION 04-1484 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, <br />AUTHORIZING AND APPROVING THE PREMIUM ONLY <br />CAFETERIA PLAN AND SUMMARY PLAN DESCRIPTION; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE <br />DATE." <br /> <br /> WHEREAS, The City of Casselberry, Florida adopted a "Cafeteria Plan" in the 1980's <br />which needs to be updated due to changes in Federal law; and <br /> <br /> WHEREAS, The Internal Revenue Code Section 125 provides for pre-tax medical <br />deductions; and <br /> <br />WHEREAS, Section 125 deductions allow employees and the City to pay less taxes. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION <br />OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS'~ <br /> <br /> SECTION I. That the form of amended Premium Only Cafeteria Plan effective April 1, <br />2003, is hereby approved and adopted by the City Commission of the City of Casselberry and <br />authorizes the Mayor to execute said Plan and deliver to the City's Admlnistrator of the Plan (as <br />defined in the plan) one or more counterparts of the Plan. A tree copy of the City's Premium <br />Only Cafeteria Plan as amended and restated is attached hereto as Exhibit "A." <br /> <br /> SECTION Il. That the City's Administrator shall be instructed to take such actions that <br />are deemed necessary and proper in order to implement the Plan, and to set up adequate <br />accounting and administrative procedures to provide benefits under the Plan. <br /> <br /> SECTION III. That the City's Administrator shall act as soon as possible to notify the <br />employees of the City of the adoption of the Cafeteria Plan by delivering each employee a copy <br />of the summary of description of the Plan in the form of the Summary Plan Description, which <br />form is hereby approved, and a true copy of which is attached as Exhibit "B." <br /> <br /> SECTION IV. Conflicts. All Resolutions or parts of Resolutions in conflict with any <br />of the provisions of this Resolution are hereby repealed. <br /> <br /> SECTION V. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br /> <br /> SECTION VI. Effective Date.
