<br />RESOLUTION 07-1746 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />EXECUTION OF THE FIRST AMENDMENT TO THE INTERLOCAL AGREEMENT <br />BETWEEN SEMINOLE COUNTY AND THE CITY OF CASSELBERRY RELATING TO THE <br />ADMINISTRATION OF THE CITY'S SHARE OF FUNDS UNDER THE CENT FOR <br />SEMINOLE LOCAL SALES SURTAX FOR THE CITY'S TRANSPORTATION <br />IMPROVEMENT PROJECTS; PROVIDING FOR CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE." <br /> <br />WHEREAS, the City of Casselbeny entered into an Interlocal Agreement with Seminole County, in <br />March of 2002, relating to the transportation improvement projects funded with the proceeds of a Second <br />Generation Local Government Infrastructure Sales Surtax; and <br /> <br />WHEREAS, City staff wishes to modifY the language in the original Interlocal Agreement to correspond <br />with the updated revenue estimates for the City transportation projects (from $9.58M to $IIM); and <br /> <br />WHEREAS, in lieu of the Pedestrian Overpass project, City staff wishes to implement the realigrunent <br />and/or pedestrian improvement projects of Triplet Lake Drive, Plumosa Avenue, Lemon Lane, Button Road, and <br />Melody Lane; and <br /> <br />WHEREAS, City staff has reviewed the First Amendment to the Interlocal Agreement with Seminole <br />County and find it to be favorable to the City. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission of the City of Casselberry hereby approves the First Amendment to <br />the Interlocal Agreement with Seminole County (attached as "Exhibit A"), and authorizes the Mayor to execute <br />said document on behalf of the City. <br /> <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of <br />this Resolution are hereby repealed. <br /> <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, <br />unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other <br />Section or part of tills Resolution. <br /> <br />SECTION IV. Effective Date.
