<br />RESOLUTION 07 -1759 - A <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, TO ENTER INTO <br />THE SECOND RENEWAL OF THE HIGHWAY MAINTENANCE MEMORANDUM OF <br />AGREEMENT WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />WHEREAS, the City of Casselberry now maintains the beautification and routine maintenance element of <br />SR 436 and Highway 17-92 within the corporate limits of the City of Casselberry; and <br /> <br />WHEREAS, the City of Casselberry wishes to continue an active role in beautification and maintenance of <br />said right-of-ways; and <br /> <br />WHEREAS, the Florida Department of Transportation has agreed to compensate the City for said <br />maintenance services; and <br /> <br />WHEREAS, it is in the public interest of the residents of the City of Casselberry to have enhanced <br />maintenance and appearance of the State roads within the City; and <br /> <br />WHEREAS, City staff has reviewed the proposed Second Renewal of Agreement between the City of <br />Casselberry and the Florida Department of Transportation and find it complete and favorable to the City. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />SECTION I. The City Commission of the City of Casselberry hereby approves the Second Renewal of the <br />Memorandum of Agreement between the Florida Department of Transportation and the City of Casselberry; <br />District Contract Job Number ANX29, Contract Number FM 244549-1-72-05 (attached as Exhibit "A"), and <br />authorizes the Mayor to execute said document on behalf of the City. <br /> <br />SECTION II. The City Commission hereby accepts the terms and conditions as presented in said <br />Agreement. <br /> <br />SECTION III. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of <br />this Resolution are hereby repealed. <br /> <br />SECTION IV. Severabilitv. If any Section or portion of a Section of this Resolution proves to be invalid, <br />unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other <br />Section or part of this Resolution. <br /> <br />SECTION V. Effective Date.
