<br />RESOLUTION 07 - 1758 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING <br />CLOSING, VACATING AND ABANDONING EASEMENT RESERVED IN <br />WARRANTY DEED, EASEMENT RECORDED IN DEED BOOK AND EASEMENT <br />AS RESERVED IN WARRANTY DEED, OF THE PUBLIC RECORDS OF <br />SEMINOLE COUNTY, FLORIDA (ALSO KNOWN AS CAMBRIDGE OAKS <br />DEVELOPMENT); PROVIDING FOR CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE." <br /> <br />WHEREAS, a petition was filed with the City Commission of the City of Casselberry, Florida, to <br />close, vacate and abandon the easements as follows: <br /> <br />1. Easement reserved in Warranty Deed recorded in Deed Book 70, Page 445; <br />2. Easement recorded in Deed Book 80, Page 240; and <br />3. Easement as reserved in Warranty Deed recorded in Deed Book 139, Page 5, <br /> <br />of the Public Records of Seminole County, Florida. as described on Exhibit "A". <br /> <br />WHEREAS, all affected utilities have reviewed the petition; and <br /> <br />WHEREAS, the City Commission finds that the closing, vacating and abandonment of of said <br />easements will not present a detriment to either the City of Casselberry, Florida, or the public. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />Section I. The City Commission of the City of Casselberry hereby approves the closing, <br />vacating and abandonment of easements described on Exhibit "A" in the City of Casselberry as of this <br />date and the City Commission of the City of Casselberry, Florida, renounces any rights in and to the <br />afore-described utility easement, attached as "Exhibit A", and authorizes the Mayor to sign the <br />resolution. <br /> <br />Section II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br /> <br />Section III. Severabilitv. If any Section or portion of a Section of this Resolution proves to be <br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or <br />effect of any other Section or part of this Resolution. <br /> <br />Section IV. Effective Date.
