RESOLUTION 07-1749 A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE TERMINATION OF THE REAL ESTATE CONTRACT BETWEEN THE CITY OF CASSELBERRY AND NAIREALVEST FOR CERTAIN CITY PROPERTIES; REMOVAL OF THE MUNICIPAL PARKING LOT PROPERTY FROM THE SURPLUS PROPERTY LIST; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City of Casselberry owns several properties that were designated as surplus land by the City Commission on July 10, 2006; and WHEREAS, the City Commission contracted with NAIRealvest on March 13,2006 to assist the City of Casselberry with the marketing of those properties; and WHEREAS, NAIRealvest has met the conditions of the contract; and WHEREAS, the City Commission of the City of Casselberry has decided to re- develop some of those properties as described in that contract, attached hereto as "Exhibit A",' in conjunction with other City owned property; and WHEREAS, the City Commission now needs to terminate the NAIRealvest contract and remove one of the properties from the surplus property list. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby terminates the Contract with NAIRealvest attached hereto as "Exhibit A". SECTION II. The City Commission removes the property referred to as the "Municipal Parking Lof', and described in "Exhibit B", from the surplus property list. SECTION III. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION IV: Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
