Reischmann <br />Stenstrom, Mcintosh, Colbert et al <br />200 West First Street <br />Sanford, FL 32772-4848 <br /> <br />RESOLUTION NO. 06-1638 <br /> <br />A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, ADOPTING A <br />STANDARD ANNEXATION AGREEMENT FORM FOR PROPERTIES CONTIGUOUS <br />TO, AND PROPERTIES NOT CONTIGUOUS TO, THE CITY LIMITS WHERE THE <br />OWNERS DESIRE TO ANNEX THE PROPERTY INTO THE CITY AND UTILIZE CITY <br />WATER OR SANITARY SEWER; PROVIDING FOR CONFLICTS AND AN EFFECTIVE <br />DATE. <br /> <br />WHEREAS, Article I, "In General" of the City of Casselberry City Code, Section 2-1 ,"Zoning", <br /> <br />empowers the City Commission to set forth regulations to ensure the orderly and desirable growth of the <br /> <br />City; and <br /> <br />WHEREAS, the Comprehensive Plan, 1990-2010 for the City of Casselberry was adopted on <br /> <br />October 4, 1993 and sets forth various goals and objectives for the City when annexing properties; and <br /> <br />WHEREAS, pursuant to City Code Sections 86-69 and 86-206, if application is made for City water <br /> <br />andlor sewer, then the property owner is required to execute an annexation petition simultaneously with the <br /> <br />application for water/sewer; and <br /> <br />WHEREAS, annexation agreements may be executed both for properties that are contiguous and <br /> <br />properties that are not contiguous to the City limits, to enable the property owner use of the City's utility <br /> <br />services prior to the actual annexation of the property into the City of Casselberry; and <br /> <br />WHEREAS, development may occur on property prior to annexation into the City; and <br /> <br />WHEREAS, the City of Casselberry desires development to be consistent with the City's zoning <br /> <br />and future land use requirements to eliminate the creation of non-conforming uses and structures at the <br /> <br />time of annexation; and <br />
