RESOLUTION 05-1561 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING ZEPHYRHILLS CORPORATION TO PROVIDE EMERGENCY WATER; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, the City of Casselberry has undertaken a vulnerability assessment that indicates the need for an alternative emergency water supply; and WHEREAS, the City needs to have in place an emergency water supply agreement to ensure that in the case of an emergency or natural disaster that the City can provide water to its customers; and WHEREAS, Zephyrhills Corporation has been competitively bid with the State of Florida and has provided similar products to area municipalities; and WHEREAS, the City staff has reviewed the Emergency Water Supply Agreement & Addendum from Zephyrhills Corporation and found it to be responsible and recommends approval. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the agreement from Zephyrhills Corporation (attached as "Exhibit A"), and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
