<br />City Commission Meeting <br />October 25, 2004 <br />Page 2 <br /> <br />The City Clerk read ordinance 1 149 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, RELATING TO <br />VOLUNTARY ANNEXATION; MAKING FINDINGS; ANNEXING TO AND <br />INCLUDING WITHIN THE CORPORATE LIMITS OF THE CITY OF <br />CASSELBERRY, FLORIDA, CERTAIN LANDS LOCATED IN SECTION 28, <br />TOWNSHIP 21 S, RANGE 30E; REDEFINING THE CORPORATE LIMITS OF THE <br />CITY OF CASSELBERRY, FLORIDA; PROVIDING FOR THE INTERIM <br />PROVISION OF LAND DEVELOPMENT REGULATIONS; PROVIDING THAT <br />CERTAIN COUNTY LICENSEES FOLLOWING THEIR BUSINESS, TRADE OR <br />PROFESSION WITHIN THE LANDS TO BE ANNEXED MAY CONTINUE TO <br />FOLLOW SUCH BUSINESS. TRADE OR PROFESSION THROUGHOUT THE <br />ENTIRE CORPORATE LIMITS WITHOUT THE NECESSITY OF FURTHER <br />QUALIFICATION THEREFORE; PROVIDING THAT EFFECTIVE IN <br />ACCORDANCE WITH LAW, THE LANDS TO BE ANNEXED SHALL BE <br />ASSESSED FOR PAYMENT OF MUNICIPAL AD VALOREM TAXES; <br />DIRECTING THE CITY CLERK TO FILE CERTIFIED COPIES OF THE <br />ORDINANCE WITH THE CLERK OF COURT AND THE SECRETARY OF ST ATE <br />OF THE STATE OF FLORIDA; AND PROVIDING FOR CODIFICATION, <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />Staff Presentation: Mr. Wells stated that the property for annexation was located adjacent to Casselberry <br />Commons and is comprised of approximately 0.5 acres of land. The owners plan to use the property for a <br />Brusters Ice Cream Retail Store. The property will also contain a billboard sign for the term of the lease by <br />virtue of a pre-annexation agreement. <br /> <br />Staff Recommendation: Approval on second reading. <br /> <br />The required legal advertisment ran in the Orlando Sentinel on October 10 and 17, 2004. <br /> <br />Mayor Pronovost asked if there was anyone in the audience that wished to address Ordinance 04- I 149, <br />either for or against. The following individual came forward: <br /> <br />Mr. Aaron Gorovity, Lowndes, Drossdick, Kantor & Reed, Law Firm representing the owners spoke <br />in favor of Ordinance 04- 1149 <br /> <br />MOTION: <br /> <br />Moved by Vice Mayor/Commissioner AI Clark to approve Ordinance 03-1149, <br />Brnsters Annexation. on second reading. The motion was seconded by <br />Commissioner Susan Doerner and carried unanimously by roll call vote. <br />
