City Commission Meeting <br />August 11, 2003 <br />Page 2 <br /> <br />PUBLIC HEARING <br /> <br />Second Reading of Ordinance 03-1092 - Building Code Revisions <br /> <br />MOTION: <br /> <br />Moved by Vice Mayor/Commissioner Al Clark that Ordinance 03-1092, <br />Building Code Revisions, be read by title only. Motion was seconded by <br />Commissioner Susan Doerner and carried unanimously by voice vote. <br /> <br />The City Clerk read Ordinance 03-1092 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA RELATING TO <br />BUILDINGS; REPEALING AND REPLACING ARTICLE IV OF THE UNIFIED <br />LAND DEVELOPMENT REGULATIONS (ULDR); INCORPORATING THE <br />FLORIDA BUILDING CODE AND CERTAIN ADMINISTRATIVE AND <br />TECHNICAL AMENDMENTS INTO THE CASSELBERRY BUILDING CODE; <br />INCORPORATING OTHER STANDARD CODES INTO THE CASSELBERRY <br />BUILDING CODE AND CERTAIN AMENDMENTS TO THE UNSAFE BUILDING <br />ABATEMENT CODE; PROVIDING FOR CONFLICTS, CODIFICATION, <br />SEVERABILITY AND AN EFFECTIVE DATE. <br /> <br />Legal advertisement for the public bearing of Ordinance 03-1092 was published in the Orlando <br />Sentinel on July 31, 2003. <br /> <br />Staff Report - The City Commission approved Ordinance 03-1092, Building Code Revisions, on first <br />reading July 28, 2003. The revisions reflect the requirement of changes that were made to the <br />Florida Statutes, mandating certain minimum requirements in local building codes. Municipalities <br />are allowed to adopt more stringent sections to the Codes that are specifically tailored for their own <br />jurisdictions; Casselberry falls within a 110 m.p.h wind zone so this was added to the Code by the <br />Building Division. The bulk of the changes were to the administrative sections - <br /> <br />a) <br /> <br />b) <br /> <br />c) <br /> <br />Section 110 was added to provide for an appeals procedure to appeal any staff decision they <br />felt were incorrect or wrongly interpreted. <br />Section 105.15 was modified to give the Public Works Department the opportunity to be <br />sure the right-of-ways were restored to their satisfaction before issuance of certificates of <br />occupancy. Also the Florida Building Code establishes that a municipality has the authority <br />to require appropriate clean-up after a construction project. <br />Section 105.5.4 was added to insure a property is rodent free before a demolition is <br />accomplished. <br /> <br />Staff Recommendation - Approve Ordinance 03-1092 on second reading and final public hearing. <br />The Planning and Zoning Commission approved the draft ordinance at their meeting of June 11, <br />2003. <br /> <br />Audience Input - None <br /> <br /> <br />
