ORDINANCE 24-1595 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO <br />AMEND THE CITY OF CASSELBERRY COMPREHENSIVE PLAN BY <br />PROVIDING FOR A CHANGE OF THE FUTURE LAND USE <br />DESIGNATION FROM SEMINOLE COUNTY INDUSTRIAL TO <br />MEDIUM DENSITY RESIDENTIAL FOR ONE PARCEL, TOTALING <br />APPROXIMATELY 4.85 ACRES, GENERALLY LOCATED TO THE <br />EAST OF AN UNIMPROVED RIGHT-OF-WAY IDENTIFIED AS DAVID <br />DRIVE AND DESCRIBED WITH PARCEL IDENTIFICATION NUMBER <br />26-20-30-5AR-OD00-055B, AS DESCRIBED IN SECTION I OF THIS <br />ORDINANCE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND <br />AN EFFECTIVE DATE. <br />WHEREAS, the subject property described in attached "Attachment A" ("Property") was <br />recently annexed into the City of Casselberry (City) corporate boundaries by Ordinance 23-1585; <br />and <br />WHEREAS, the Property has a Seminole County Future Land Use Map (FLUM) <br />designation of Industrial; and <br />WHEREAS, the Property needs a City FLUM designation; and <br />WHEREAS, to allow for appropriate future development, the Property should be <br />developed consistent with the land uses of neighboring parcels; and <br />WHEREAS, the Property is less than 50 acres, requiring a small-scale amendment to the <br />Comprehensive Plan; and <br />WHEREAS, Section 163.3187 of the Florida Statutes establishes a process for the <br />adoption of small-scale comprehensive plan amendments, including amendments to the Future <br />Land Use Map (FLUM); and <br />WHEREAS, the Planning and Zoning Commission/Local Planning Agency has held a <br />public hearing with due public notice to consider this FLUM amendment; and <br />WHEREAS, a public hearing considering amendment of the City of Casselberry FLUM <br />designation for the property hereinafter described, has been duly held by the City Commission of <br />the City of Casselberry, Florida, and at such hearing, interested parties and citizens were heard; <br />and <br />WHEREAS, after said public hearing, the City Commission of the City of Casselberry, <br />Florida, considered the Comprehensive Plan amendment and determined that the Future Land Use <br />designation of the Property, consisting of approximately 4.85 acres, shall be established as <br />Medium Density Residential, as defined in Future Land Use Element Objective FLU 1, as <br />amended and supplemented, of the Comprehensive Plan of the City of Casselberry, Florida; and <br />WHEREAS, such amendment is permitted, subject to the provisions of Chapter 163 of the <br />Florida Statutes. <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />
