ORDINANCE 23-1586 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING THE CITY'S UNIFIED LAND DEVELOPMENT <br />REGULATIONS TO ADD SECTION 2-5.5, AFFORDABLE HOUSING, TO <br />REQUIRE A RESTRICTIVE COVENANT TO BE IMPOSED ON <br />AFFORDABLE HOUSING DEVELOPMENTS, AND PROVIDING A <br />TIMELINE FOR CONSTRUCTION; PROVIDING STANDARDS FOR <br />MULTIFAMILY DEVELOPMENT BY AMENDING THE CITY'S <br />UNIFIED LAND DEVELOPMENT REGULATIONS TO ADD SECTION 3- <br />10.14, MULTIFAMILY DESIGN STANDARDS; AMENDING SECTION 5- <br />21.2 OF THE CITY'S UNIFIED LAND DEVELOPMENT REGULATIONS <br />TO PROVIDE DEFINITIONS OF TERMS, INCLUDING <br />"ADMINISTRATIVELY APPROVED," "COMMERCIAL," <br />"DESIGNATES," "MIXED USE RESIDENTIAL," "MIXED USE ZONING" <br />AND "ZONED," AS USED IN FLA. STAT. 166.04151 (2023), AND OTHER <br />RELATED TERMS; PROVIDING FOR CODIFICATION, CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry continuously monitors and reviews the Unified Land <br />Development Regulations (ULDR) of the City's Code of Ordinance to ensure the City adopts <br />appropriate regulations for development and zoning within the City, and from time to time <br />recognizes the need to amend aspects of same; and <br />WHEREAS, currently, the ULDR does not contemplate or address the Live Local Act <br />adopted in the 2023 Legislative Session, amending Fla. Stat. 166.04151 (the "Act"); and <br />WHEREAS, the Act took effect on July 1, 2023, and intends to streamline and incentivize <br />affordable housing developments within the State of Florida by preempting particular use, density, <br />and height regulations for such qualifying developments in commercial, industrial, or mixed-use <br />zoning districts; and <br />WHEREAS, the Act also provides that if a municipality has designated less than 20% of <br />the land area within its jurisdiction for commercial or industrial use, any proposed qualifying <br />development authorized by Fla. Stat. 166.04151 must be mixed-use; and <br />WHEREAS, the City recognizes the need for affordable housing and supports a revision <br />to its ULDR in order to establish equitable and thoughtful regulations for the development of <br />mixed-use and mixed -income multifamily residential projects and to modify certain processes for <br />implementation of regulations pertaining to the Act; and <br />WHEREAS, words with double underlined type shall constitute additions to the original <br />text, Jeri g h shall constitute deletions to the original text, and asterisks (* * *) indicate that <br />text shall remain unchanged from the language existing prior to the adoption of this Ordinance. <br />
