RESOLUTION 15-2755 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />EXECUTION OF AMENDMENT #11 TO THE GENERAL <br />CONSTRUCTION MANAGEMENT AT RISK AGREEMENT WITH <br />WHARTON-SMITH, INC. FOR INSTALLATION OF A COATING <br />SYSTEM FOR THE SOUTH WATER TREATMENT PLANT ELEVATED <br />WATER TOWER; PROVIDING FOR CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE. <br />WHEREAS, the City maintains a robust potable water production and distribution <br />system which includes three potable water storage towers; and <br />WHEREAS, the South Water Treatment Plant (SWTP) is the site for one of the potable <br />water storage towers; and <br />WHEREAS, the SWTP elevated water tower has not been re -coated with a coating <br />system in over eighteen years; and <br />WHEREAS, on February 13, 2012 via Resolution 12-2344, the City Commission <br />approved a General Construction Management at Risk Agreement with Wharton -Smith, Inc. for <br />construction projects valued less than $2 million; and <br />WHEREAS, Wharton -Smith, Inc., has submitted Amendment 411 as a guaranteed <br />maximum price (GMP) proposal for installation of a coating system for the SWTP elevated <br />water tower; and <br />WHEREAS, Public Works staff has reviewed Amendment #11 to the agreement with <br />Wharton -Smith, Inc. and finds it favorable to meet the needs of the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves <br />Amendment #11 to the agreement with Wharton -Smith, Inc., for installation of a coating system <br />for the South Water Treatment Plant elevated water tower, in the amount of $531,318, and <br />authorizes the Mayor to execute said document on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />
