RESOLUTION 09-2047 <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, <br />AUTHORIZING THE EXECUTION OF A COOPERATIVE PURCHASE <br />AGREEMENT AND APPROVAL OF A PROPOSAL BETWEEN ORLANDO <br />PAVING COMPANY AND THE CITY OF CASSELBERRY FOR THE MILLING <br />AND RESURFACING OF SELECT CITY STREETS; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />WHEREAS, the City of Casselberry has recently completed a City-wide roadway <br />assessment for the City's public streets; and <br />WHEREAS, Timberlane Trail, Surrey Run, and Sundown Trail are some of the lowest rated <br />streets in the City and are in need of rehabilitation; and <br />WHEREAS, City staff have determined that milling and resurfacing of these selected streets <br />is the appropriate corrective measure; and <br />WHEREAS, sufficient funding for milling and resurfacing of the aforementioned streets is <br />available in the adopted Fiscal Year 2008-2009 Budget for Road and Street Facilities; and <br />WHEREAS, Orlando Paving Company has been competitively bid with Seminole County <br />and has performed similar services for the City; and <br />WHEREAS, Public Works staff has reviewed the proposal submitted by Orlando Paving <br />Company and has found it to be responsible and adequate to meet the project requirements of the <br />City. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the <br />cooperative purchase agreement with Orlando Paving Company, attached as "Exhibit A", and the <br />related proposal, attached as "Exhibit B", and authorizes the Mayor to execute said documents on <br />behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon <br />its passage and adoption. <br />
