RESOLUTION 09-2047 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE EXECUTION OF A COOPERATIVE PURCHASE AGREEMENT AND APPROVAL OF A PROPOSAL BETWEEN ORLANDO PAVING COMPANY AND THE CITY OF CASSELBERRY FOR THE MILLING AND RESURFACING OF SELECT CITY STREETS; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, the City of Casselberry has recently completed a City-wide roadway assessment for the City's public streets; and WHEREAS, Timberlane Trail, Surrey Run, and Sundown Trail are some of the lowest rated streets in the City and are in need of rehabilitation; and WHEREAS, City staff have determined that milling and resurfacing of these selected streets is the appropriate corrective measure; and WHEREAS, sufficient funding for milling and resurfacing of the aforementioned streets is available in the adopted Fiscal Year 2008-2009 Budget for Road and Street Facilities; and WHEREAS, Orlando Paving Company has been competitively bid with Seminole County and has performed similar services for the City; and WHEREAS, Public Works staff has reviewed the proposal submitted by Orlando Paving Company and has found it to be responsible and adequate to meet the project requirements of the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the cooperative purchase agreement with Orlando Paving Company, attached as "Exhibit A", and the related proposal, attached as "Exhibit B", and authorizes the Mayor to execute said documents on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and adoption.
