RESOLUTION 08-1867 8 "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE EXECUTION OF AN INTERLOCAL AGREEMENT BETWEEN SEMINOLE COUNTY AND THE CITY OF CASSELBERRY FOR THE TRANSFER OF OWNERSHIP OF BELLE AVENUE; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, the City of Casselberry vacated the southern portion of Belle Avenue in anticipation of the North Winter Park Drive Realignment Project; and WHEREAS, it was determined that a jurisdictional transfer from Seminole County is necessary; and WHEREAS, Seminole County has submitted an Interlocal Agreement transferring the ownership, maintenance, and functional responsibility of this roadway to the City; and WHEREAS, City staff has reviewed the Agreement submitted by Seminole County and find it to be favorable to the City. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION 1. The City Commission of the City of Casselberry hereby approves the Interlocal Agreement between Seminole County and the City of Casselberry (attached as "Exhibit A"), and authorizes the Mayor to execute the said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and adoption. PASSED and ADOPTED this h. day of % J %La -� - .� M AD 2008.
