RESOLUTION 08-1867 A "A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE EXECUTION OF A PARKING AGREEMENT BETWEEN THE SOUTH SEMINOLE LODGE 364 OF THE FREE AND ACCEPTED MASONS OF FLORIDA AND THE CITY OF CASSELBERRY; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, the City has jurisdiction over certain public property located within the incorporated limits of the City and the Masonic Lodge desires to utilize parking on the City of Casselberry, City Hall site; and WHEREAS, the Masons have jurisdiction over certain private property located within the incorporated limits of the City and the City of Casselberry desires to utilize parking on the Masonic Lodge site; and WHEREAS, City of Casselberry property is held by the City for the benefit and general use of the public for functions including, but not limited to, vehicular and pedestrian travel and land access; and WHEREAS, Masonic Lodge property is held by the Masons for the benefit and general use of their organization for functions including, but not limited to, vehicular and pedestrian travel and use; and WHEREAS, written authorization and lawful authority is required for any private use of public lands or public use of private lands; and WHEREAS, the Masons have requested authorization from the City to utilize the city property for parking for the benefit of the Masons and the general public and reciprocally the City has requested authorization from the Masons to utilize the Masonic property for parking for the benefit of the City and the general public. WHEREAS, this reciprocal agreement would benefit both parties and allow for better parking in the existing downtown area. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the agreement for the reciprocal parking between the South Seminole Lodge 364 of the Free and Accepted Masons of Florida and the City of Casselberry (attached hereto as "Exhibit A"), and authorizes the Mayor to execute said documents on behalf of the City. SECTION 11. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed.
