RESOLUTION 10-2109 <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA APPROVING AND <br />AUTHORIZING ENTERING INTO A LICENSE AGREEMENT BETWEEN THE CITY <br />OF CASSELBERRY AND STERLING PARK HOUSING ASSOCIATION, INC. FOR <br />WIRZ TRAIL SECTION II, PROVIDING FOR CONFLICTS, SEVERABILITY AND <br />EFFECTIVE DATE." <br />WHEREAS, trail systems are a valuable asset to the vibrancy of a community providing <br />outlets and opportunities for both recreation and transportation; and <br />WHEREAS, trail systems provide an economic benefit to cities and neighborhoods <br />where trails exist and are a significant element of the City of Casselberry's Comprehensive Plan; <br />and <br />WHEREAS, the City of Casselberry has completed the construction of Wirz Trail <br />Section II, and a portion of the trail traverves on land owned by Sterling Park Housing <br />Association, Inc. in Seminole County; and <br />WHEREAS, the City desires to enter into a License Agreement with Sterling Park <br />Housing Association, Inc. in order to operate and maintain the portions of Wirz Trail Section II <br />that traverses on land owned by Sterling Park Housing Association, Inc. in Seminole County. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the <br />License Agreement with Sterling Park Housing Association, Inc. (attached as Exhibit "A") and <br />authorizes the Mayor to execute said document on behalf of the City <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV.
