RESOLUTION 20-3216 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING A UTILITY EASEMENT <br />AGREEMENT WITH CASTO CASSELBERRY LLC FOR THE LAKE <br />CONCORD PARK COMMERCIAL SUBDIVISION; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the subject property is Lot 4 of the Lake Concord Park, Unit IA, Replat, as <br />recorded in the Seminole County Public Record, Book 79, Pages 90-93; and <br />WHEREAS, the replat of this property requires that a Utility Easement Agreement with <br />the property owner be made with the City of Casselberry; and <br />WHEREAS, Casto Casselberry LLC, the owner of part of the Lake Concord Park <br />Commercial Subdivision property, has executed a utility easement agreement in favor of the City; <br />and <br />WHEREAS, this agreement conveys a non-exclusive public easement over certain portions <br />of the property to the City for the construction, installation, operation, maintenance, replacement, <br />and repair of utilities; and <br />WHEREAS, City staff has reviewed the Utility Easement Agreement and have found it <br />favorable to meet the needs of the City. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the Utility <br />Easement Agreement with Casto Casselberry LLC for the Lake Concord Park Commercial <br />Subdivision, attached herewith, and authorizes the Mayor to execute said document on behalf of the <br />City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon <br />its passage and adoption. <br />PASSED and ADOPTED this day oft%; , AD 2020. <br />
