RESOLUTION 13-2526 "A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE ACCEPTANCE OF A SIDEWALK EASEMENT TO THE CITY OF CASSELBERRY FROM HILL/GRAY SEVEN, L.L.C.; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." WHEREAS, an eight foot wide sidewalk along the east side of North Oxford Road is envisioned as part of the City's complete street concept for this road; and WHEREAS, in order to accommodate an eight foot wide public sidewalk along the property owned by Hill/Gray Seven, L.L.C., a sidewalk easement is required; and WHEREAS, Hill/Gray Seven, L.L.C. has agreed to provide a sidewalk easement and has executed the same; and WHEREAS, City staff has reviewed the sidewalk easement granted by the Hill/Gray Seven, L.L.C. and finds it sufficient to meet the needs of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves and accepts the Sidewalk Easement from Hill/Gray Seven, L.L.C. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
