ORDINANCE 22-1563 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO <br />AMEND THE CITY OF CASSELBERRY COMPREHENSIVE PLAN BY <br />ADDING A PROPERTY RIGHTS ELEMENT IN ACCORDANCE WITH <br />MANDATES SET FORTH IN CHAPTER 163, FLORIDA STATUTES; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE <br />DATE. <br />WHEREAS, Section 163.3167, Florida Statutes, requires the City of Casselberry (City) <br />to maintain a comprehensive plan to guide its future development and growth; and <br />WHEREAS, Section 163.3177(6)(i)l., Florida Statutes, requires the City's <br />Comprehensive Plan to include a property rights element; and <br />WHEREAS, the City respects judicially acknowledged and constitutionally protected <br />private property rights; and <br />WHEREAS, Section 163.3184 of the Florida Statutes establishes a process for adoption <br />of comprehensive plans or plan amendments; and <br />WHEREAS, the Planning and Zoning Commission, as the City's Local Planning Agency, <br />has held a public hearing with due public notice to consider this amendment to the City's <br />Comprehensive Plan; and <br />WHEREAS, a public hearing considering amendment of the City's Comprehensive Plan <br />has been duly held by the City Commission of the City of Casselberry, Florida, and at such hearing, <br />interested parties and citizens were heard; and <br />WHEREAS, words with double underlined type shall constitute additions to the original <br />text and stfike thfough type shall constitute deletions to the original text, and asterisks (* * *) <br />indicate that text shall remain unchanged from the language existing prior to adoption of this <br />Ordinance. <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission does hereby adopt Section 11 Property Rights <br />Element into the City of Casselberry's Comprehensive Plan, attached hereto as Attachment "A". <br />SECTION II. CONFLICTS. All Ordinances or parts of Ordinances in conflict with any <br />of the provisions of this Ordinance are hereby repealed to the extent of the conflict. <br />
