ORDINANCE 22-1564 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />CREATING SECTIONS 78-3 AND 78-4, ARTICLE I, GENERAL, OF <br />CHAPTER 78, TAXATION, AUTHORIZING THE INCLUSION OF <br />CERTAIN PROPERTY LOCATED WITHIN THE CITY OF CASSELBERRY <br />IN THE DEER RUN MUNICIPAL SERVICE BENEFIT UNIT CREATED <br />AND ESTABLISHED BY SEMINOLE COUNTY, FLORIDA, FOR THE <br />PURPOSE OF PROVIDING STABILIZATION NEEDS, INCLUDING, BUT <br />NOT LIMITED TO, RENOVATION AND REFURBISHMENT OF <br />RECREATIONAL FACILITIES FOR USE AS A COMMUNITY CENTER, <br />DRAINAGE AND OTHER ESSENTIAL FACILITIES WITHIN THE UNIT; <br />PROVIDING IDENTIFICATION OF PROPERTY WITHIN THE CITY OF <br />CASSELBERRY AUTHORIZED FOR INCLUSION IN SAID UNIT; <br />PROVIDING FOR PERIOD OF EFFECTIVENESS; PROVIDING FOR <br />CODIFICATION, CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the City of Commission of the City of Casselberry, Florida, has entered into the <br />Interlocal Agreement Between Seminole County and City of Casselberry Seminole County for the <br />Former Deer Run Golf Course Property Stabilization Needs, whereby the City has agreed to authorize <br />inclusion of certain lands within the City of Casselberry into a Municipal Service Benefit Unit <br />("MSBU") to be created and established by Seminole County for renovation and refurbishment of <br />recreational facilities, drainage and other essential facilities within the former Deer Run golf course; <br />and <br />WHEREAS, the Board of County Commissioners of Seminole County, Florida, has the <br />authority to establish a Municipal Service Benefit Unit pursuant to Chapter 125, Florida Statutes, and <br />other controlling law; and <br />WHEREAS, the communities of Field Club and Hunter's Chase located within the City of <br />Casselberry will benefit from the use of the former golf course as a community recreation facility, <br />open space and for stormwater management; and <br />WHEREAS, pursuant to Chapter 163, Florida Statutes, local governments are encouraged to <br />cooperate on the basis of mutual advantage to provide services that will influence the needs of local <br />communities; and <br />WHEREAS, the City Commission of the City of Casselberry enacts this Ordinance to ensure <br />that the high quality of life available to citizens of the City and the County is protected and maintained; <br />and <br />WHEREAS, Article VII, Section 2, Constitution of the State of Florida, authorizes the City of <br />Ordinance 2022-1564 <br />Page 1 <br />
