RESOLUTION 20-3183 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />EXECUTION OF A LOCAL AGENCY PROGRAM AGREEMENT WITH <br />THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION FOR <br />THE WINTER PARK DRIVE COMPLETE STREET AND CONCEPT <br />DEVELOPMENT STUDY; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry is committed to making its community safer, more <br />comfortable, and more connected for people of all ages and abilities to walk, roll, and bike; and <br />WHEREAS, the City of Casselberry has, through its Healthy Community Complete Streets <br />Policy and Design Guidelines, adopted the bold goal to "become the most walkable, rollable, and <br />bikeable City in Central Florida" by 2040; and <br />WHEREAS, in 2019 the City submitted to MetroPlan Orlando a request to prioritize and <br />fund a corridor planning study for complete street improvements to all of North and South Winter <br />Park Drive; and <br />WHEREAS, the proposed planning study was programmed into the State of Florida <br />Department of Transportation's (FDOT's) Work Program for State Fiscal Year 2020-2021; and <br />WHEREAS, a Local Agency Program (LAP) Agreement with FDOT is necessary in order <br />for the project to be completed using federal funds; and <br />WHEREAS, FDOT has provided a proposed LAP Agreement for this purpose; and <br />WHEREAS, City staff has reviewed the aforementioned Agreement and finds it acceptable <br />to meet the needs of the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Cominission of the City of Casselberry hereby approves the Local <br />Agency Program Agreement with the State of Florida Department of Transportation for the Winter <br />Park Drive Complete Street and Concept Development Study and authorizes the Mayor to execute <br />said document, attached herewith, on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon <br />its passage and adoption. <br />
