RESOLUTION 20-3202 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />CITY MANAGER TO REQUEST IMMEDIATE WITHDRAWAL FROM <br />AGREEMENT P9022 WITH THE FLORIDA DEPARTMENT OF <br />ENVIRONMENTAL PROTECTION FOR A FLORIDA RECREATION <br />DEVELOPMENT ASSISTANCE PROGRAM GRANT FOR " WHEEL <br />PARK" - PHASE 1; PROVIDING FOR CONFLICTS, SEVERABILITY, <br />AND EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry's 2017 Parks, Recreation, Pathways, and Open Spaces <br />Master Plan included a recommendation to develop a new park in the northern part of the City; and <br />WHEREAS, the City Commission of the City of Casselberry has committed to preserve the <br />City -owned "Northeast Industrial Park" properties for future park space; and <br />WHEREAS, a proposed City project under the working name "Wheel Park" - Phase 1 will <br />provide the first phase of development of the Northeast Industrial Park properties by providing new <br />recreational opportunities for children; and <br />WHEREAS, the purpose of "Wheel Park" - Phase 1 is to provide wholesome outdoor <br />recreational activities for the residents of the City of Casselberry, Florida; and <br />WHEREAS, the City of Casselberry, on August 15, 2018, applied to the Florida <br />Department of Environmental Protection (FDEP) for $250,000 in Florida Recreation Development <br />Assistance Program (FRDAP) funding with a $250,000 local match commitment, for a total of <br />$500,000 to construct "Wheel Park" - Phase 1; and <br />WHEREAS, FDEP ranked the City of Casselberry's application #7 in the State of Florida <br />and awarded the requested grant funding for the City's project; and <br />WHEREAS, FDEP provided the City of Casselberry Grant Agreement P9022 to execute <br />the project under the terms of the grant, which was approved by the City Commission via <br />Resolution 19-3094 on May 13, 2019; and <br />WHEREAS, City staff has determined that the proposed project cannot be responsibly <br />designed and constructed by the Agreement's project completion deadline of April 30, 2021; and <br />WHEREAS, FDEP has indicated the project is ineligible for time extensions; and <br />WHEREAS, the project site will remain ineligible to apply for future FRDAP grants as long <br />as there is an active FRDAP Grant Agreement; and <br />WHEREAS, City staff has determined it is in the City's best interest to immediately <br />withdraw from the current Grant Agreement (P9022) so that the site becomes eligible for future <br />FRDAP grant applications. <br />
