City of Casselberry I Procurement and Contract Management Division <br />95 Triplet Lake Drive, Casselberry, Florida 32707 <br />Phone: 407-262-7700, Ext. 1142 1 procurement(d)casselberry. org <br />RFP -2020-0636 COMMERCIAL SOLID WASTE SERVICES AGREEMENT FOR FRONTLOAD <br />DUMPSTER, CART, COMPACTOR AND OTHERWISE PUTRESCIBLE SOLID WASTE <br />AGREEMENT <br />THIS AGREEMENT is made by and between the CITY OF CASSELBERRY, a municipal <br />corporation existing under the laws of the State of Florida, 95 Triplet Lake Drive, Casselberry, <br />Florida 32707, hereinafter referred to as the "CITY," and WCA OF FLORIDA, LLC, 1378 S. <br />Volusia Avenue #A, Orange City, Florida 32763, hereinafter referred to as the "FRANCHISEE" <br />as follows: <br />Definitions pertaining to this Agreement are found in City Code Section 70-31. <br />1.00 Term <br />(a) This Franchise shall begin on January 1, 2021, and continue through December 31, <br />2025, and may be extended for two additional 5 years terms at the sole option of the <br />City when in the best interest of the City. <br />2.00 Exclusive Service <br />(a) Minimum service. The Franchisee shall make at least two weekly collections at all <br />commercial establishments generating putrescible waste subject to the terms of this <br />Franchise and at sufficient additional intervals necessary to protect the environment, <br />unless otherwise approved in advance by the City, provided, however, where the <br />refuse is exclusively non-putrescible in nature, once weekly collections are <br />permitted. Commercial establishments may be required to have more than two <br />weekly collections if needed and when notified by the City. Such collections shall be <br />the responsibility of the commercial establishment to schedule and pay for such <br />collections. <br />(b) Emergency Service during Uncontrollable Force. In the event of a major storm, the <br />Franchisee shall make available adequate equipment and personnel to remove <br />any and all debris placed in the containers by its customers, within twelve (12) <br />hours of notification from the Public Works Director or designee of an approaching <br />hurricane, tornado, or similar uncontrollable force or as described in Section 27.00. <br />3.00 Collection Schedules/Service Requests/Interruptions <br />(a) The City shall maintain records of the Solid Waste Management services that are to <br />be provided to the commercial customers. At least two weeks before the start of <br />this Franchise, the Franchisee shall provide the City with an electronic list of all <br />customers, including customer name, service address, container size and <br />identification number, pick-up frequency, and special instructions. The Franchisee is <br />responsible for executing contracts or service agreements with all commercial <br />establishments. <br />(b) The City reserves the right to deny the Franchisee's vehicles access to certain <br />streets, alleys, and public rights-of-way, inside the City, where it is in the best interest <br />of the general public to do so due to conditions of streets or bridges. The Franchisee <br />shall not interrupt the regular schedule or quality of services because of such street <br />closures. <br />
