Non-putrescible Trash shall mean such discarded combustibles as paper, wood. yard <br />trimmings, leaves, and non -combustibles such as metal. Mass, stone, and dirt. <br />Recyclable materials means those components of solid waste capable of being recycled, <br />including newspaper; glass; food and beverage containers; aluminum, tin-plated steel and bi- <br />metal cans; polyethylene terephthalate (PET) and high-density polyethylene (HDPE); and any <br />other solid waste materials which are from time to time so designated by the City. <br />Residential collection unit means all dwelling units, mobile homes in mobile home parks, <br />each multifamily dwelling unit receiving individual collection for each unit, and mobile homes <br />with RP license tags, but excludes residential units receiving dumpster service. as of the date of <br />adoption of the ordinanee ffem which this Seetion is derived-. <br />Solid Waste means discarded materials from any household or commercial or institutional <br />entity including garbage, non-putrescible trash, and recyclable materials. <br />Special material shall mean bulky materials or other special wastes that are not stored in <br />standard storage containers and cannot be picked up by a commonly used collection vehicle. <br />These include major appliances, furniture, building materials, tree limbs, non -containerized trash <br />piles, or any abnormal amount of refuse not suitable for containerization which will be picked up <br />by calling the office of the franchisee and arranging for special service to be billed on basis of <br />labor, truck costs, and dumping charges. <br />Sec. 70-32. - Penalties; enforcement of Article. <br />(a) Any person engaged in the business of collecting waste or rendering solid waste services <br />who is not authorized by the City shall be guilty of a violation punishable in accordance <br />with Section 1-13. <br />(b) The violation of Sections 70-33, 70 52 70-38, and 70-52 shall be punishable as <br />follows: <br />(1) For the first conviction, by a fine of not less than $100.00 and not more than $125.00. <br />(2) For a second conviction within one year, by a fine of not less than $125.00 and not <br />more than $150.00. <br />(3) For a third conviction within one year, by a fine of not less than $150.00 and not more <br />than $100.00 200.00. <br />(4) For a fourth and each subsequent conviction within one year, by a fine of not less than <br />$100.08 $200.00 and not more than x. )0-.-&350.00. <br />(c) The City, at its option, may utilize its Code Enforcement Board for enforcement of this <br />Article, which can temporarily or permanently revoke the franchise. <br />Sec. 70-33. - Collection required; collection franchise. <br />(a) The City shall collect, or cause to be collected through issuance of a negotiated franchise, <br />all solid waste and (residentially -generated) recyclable materials at regular intervals to be <br />determined by the City.
