RESOLUTION 09-2019 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, REPEALING RESOLUTION 06-1638 AND GRANTING AUTHORITY TO THE CITY MANAGER TO ESTABLISH, AND MODIFY WHEN NECESSARY, A STANDARD ANNEXATION APPLICATION AND ANNEXATION AGREE- MENT FOR PROPERTIES CONTIGUOUS TO AND PROPERTIES NOT CONTIGUOUS TO THE CITY LIMITS WHERE THE OWNERS DESIRE TO ANNEX THE PROPERTY INTO THE CITY AND UTILIZE CITY WATER OR SANITARY SEWER; PROVIDING FOR CONFLICTS, SEVERABILITY AND EFFECTIVE DATE. Whereas, on January 9, 2006, the City Commission approved Resolution 06- 1638 adopting Standard Annexation Agreement forms (Exhibits A and 13) for commercial and residential properties contiguous to and properties not contiguous to the City limits who desire to utilize the City's water and/or sanitary sewer utilities; and Whereas, pursuant to City Code Sections 86-69 and 86-206, property owners are required to execute an Annexation Agreement when applying for water and/or sewer utility services for properties located outside the City limits; and Whereas, it has been determined that one, more simplified version of the two Annexation Agreement forms, coupled with an initial Annexation Application, would be beneficial for both the property owners seeking annexation and for City staff; and Whereas, the general purpose of Resolution 09-2019 is to grant the City Manager the authority to establish the Annexation Application and revised Annexation Agreement forms, and to modify them when necessary to conform with recent Court decisions and changes in the law; and Whereas, Annexation Agreements will be tailored to the individual applicant(s), allowing for non -applicable sections to be removed when not needed in the body of the Annexation Agreement; and Whereas, this system will simplify and expedite the process for citizens and businesses to move forward with Annexation Applications for water and/or sewer service for properties contiguous to, and properties not contiguous to, the City limits. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION ONE. Resolution 06-1638 is hereby repealed.
